Thanks. I was unaware "hotel" owned pools.
So the new Poly2 Tower will also be a "hotel" property containing DVC villas? I thought the entire property was owned by DVC, so a separate association would be much more likely.
I think I wrongly assumed the same for RIV....owned by DVC but allowing cash guests- which is why I wondered if amenities access could be restricted to Poly1 owners if Poly2 is a separate association.
(If we enjoyed pool-hopping privileges again, it would be a moot point!)
The entire location is part of the Poly Village resort….so, the current villas and bungalows are located at the resort and the Poly tower is being built at the resort…association designation doesn’t change that.
When PVB was designed, they declared a set of boundaries that define DVC for the project and that is what determined the ground lease,
The same will happen with the DVC tower….it will have boundaries that define the ground lease.
The association really comes into play with other aspects of how it functions, but at any DVC resort that is located at a hotel location, DVC owners get access to the amenities that belong to the hotel. Owners pay there share to use them,
That is why PVB owners and Poly tower owners, regardless of association, will get access to the current pools based on the hotel divisions discretion as to how to do it.
If the tower becomes part of PVB, then access to current pools must be the same for owners of both…
If it’s a new association, then technically, they could write the POS differently that bans Poy tower guests from those pools, but it makes no sense for the hotel to decide to give some owners of one association access, and not others.
The new pool is different. Based on its location, my guess is it will be declared part of DVC. That means that DVD and the hotel division will have to decide how to treat it for access. If it is like BLT, then only those staying at the tower would have access. If it’s like the WL, in which the hotel owns one pool and BRV owns the other, then the POS could be written for reciprocal use.
I just can’t see any situation in which they are going to try to manage only certain guests using some pools and not others, At BLT, CR guests can’t use BLT pool…but the CR is farther away from it, Some of the Poly longhouses on the cash side are going to be closer to the new pool than the current DVC units.
And, the biggest difference is that both BLT and CR have feature pools with slides, etc. The pool at the tower doesn’t appear to be that way…which is why I do not see them restricting a Poly tower guests from using the Volcano pool.
