We had an "incident" today. I'm too mentally exhausted to get into it. I'll tell the whole story maybe later. If I can stop crying.

Jon is FINE.

The bully struck again.

Only this time Jon spoke up. :cool1: :cool1: :cool1:

The police were called and the child was arrested.

Jon's not the only one he has been "bullying"...which is more like attacking.

3 other students filed charges this afternoon...including 2 children with down syndrome. :mad: :mad: :mad: :mad: :mad:

Jon has fingerprints on his neck where he was choked today...and a bruise on his stomach from yesterday.

Well I can finally announce that I'm in wooooohooooo, I had my call over 3 hours ago but had to keep quiet, I also just received an e-mail with a link with Mickey and Co congratulating me :yay:

Here's what happened.

This will probably be long.

Remember back to the beginning of school...he had these 2 boys in class bullying him. Well, we THOUGHT that was taken care of. They got in trouble...one boy was moved from the school, the other boy was supposed to be moved across the room from Jon and was to not have "access" to him.

Well, a few weeks ago things started again...now Jon tells me he's been putting up with it all year but was too afraid to say anything.

This boy was choking Jon. Hitting him. Verbally abusing him.

Jon came home one day a few weeks ago and told me what was happening. I asked if he told the teacher...and basically, no he didn't...but he implied that the student was being corrected because the teacher caught this student in the act.

Jon comes home the NEXT day...same story. Jon again says the teacher corrected the student.

Jon comes home the NEXT day...same story. This time I call the teach. She states that she didn't know this student was laying hands on Jon. When she "corrected" him in class, it was for him being up and out of his seat...not for doing anything to Jon. And Jon had never told her what was happening.

Teach immediately goes to the principal. The student is reprimanded...placed in ISS, and the parents are called in.

The student then lays low for a few days...even being a little nice to Jon. Jon said at the time he thought this boy was going to be his "friend". My boy is too trusting.

I got a call from the principal during this time assuring me that this student had been reprimanded and that the situation was handled. This was when I spoke to you guys about it last week.

Fast forward to yesterday, Jon comes home and shows me his stomach. This boy has punched him in the stomach at lunch and has put a bruise on him. I immediately called the principal...and told him what had happened. Jon didn't tell at school because he was scared. The principal assured me things would be handled today...Jon would be called down and things would be handled. Jon and I had a loooong talk about the importance of speaking up for himself...which he doesn't do. That's part of Jon...he doesn't give himself a voice.

We wrote a statement together about yesterday's events and sent it to school today.

Now...here's where it gets dicey.

I pull up outside of Jon's school to pick him up and I get a phone call from the counselor in the school. She says that there was another incident today...and the student told Jon he wanted to kill him and that he was choked. She assured me Jon was fine. I asked if I should come in, and was told that everything had been handled.

(Apparently, in 6th period, this kid cornered Jon in class and choked him and told him to die. Jon had NOT been called down to the office as promised.)

All of a sudden, Jon is coming out of the school with a teacher. And he has marks on his neck...from this child choking him. Scratches and a bruise.

And I am FUMING.

The teacher says that the police are there...and that they have already taken Jon's statement.

WHAT???? :eek: Taken my kid's statement? If it's that serious, why wasn't I called???

And I went OFF.

We go inside...and the police are there...along with the child, the principals, and some other children. Once I show up, they apparently knew it was business, and they call the other parents.

All of the children gave statements without their parents. :mad: :mad: :mad: No parents were called.

All of the parents had to fill out paperwork for charges to be filed against this child.

2 of the other children that had been attacked have Down Syndrome. This kid is just sick.

I left after we finished filling out paperwork...but as the night has gone on...I'm more and more and more pissed.

Why was Jon required to give a statement without me there? Why wasn't I called? If it's this serious...why wasn't I called? Why wasn't Jon called down to the office first thing this morning after the incident yesterday? Instead...this kid was allowed to put hands on my kid AGAIN...and I was called as an afterthought after it was all over??? No WAY!

I'm pissed. And I don't know what I should do.

This kid was arrested...but because he's only 12...he was not taken to jail. I don't want him back in the school. What should I do????

A few weeks ago, kids were throwing rocks at him during PE. Before that, two kids were running up to him and poking him in the stomach. Another kid calls him a f@got everyday. I'm ready to jerk a knot in those little sh*t heads.

I don't know if I should tell him to hit back...not that he would if I told him he should. He's such a soft-spoken little thing...and little is the appropriate word. He's very small due to his growth problems...and he is therefore an easy target.

I slapped back. I was a hateful little thing when I was in school. Not a bully...but one of those girls who when approached with an attitude, I gave it right back.

Jon won't stick up for himself. At all.

I hurt for him. :sad1:

TE - The cabin is near Murphy in the southwest tip of NC. We stayed just north on the opposite side of the mountains in Sevierville/Pigeaon Forge, TN a couple of years ago. I think this place will be a little more isolated from the sound of it.

Angela - We saw David at the EFX show in Vegas 10 years ago. He did a fantastic job. I've never heard of Nuvo. Looks and sounds delish.

Dawn - I hope you find out something at the doctor's tomorrow. It sounds very frustrating.

G-Luv - I want to know what kind of parents this kid has. I hope Jon is OK!

jen , first :hug: :hug: , i don't understand how a minor can give a statement without the parent/guardian present. this makes no sense to me!! i would def go to the school and talk with them. maybe first you should contact a lawyer to see what your rights are. i have no clue, but i just can't fathom how a child could give a statement to the police and not have the parents called. never mind the fact that they should have called you with the situation. if it left marks on him, i would assume that would mandate the parent notified. wow!! that's just scary! :hug: :hug:

I'll be back for the normal *daily* thing but I really want to address Jen/Jon's issue.

Rachel is ABSOULUTELY right. Call a lawyer. Right away. That school was doing everything in it's power to avoid having to be responsible for not protecting Jon and those other children. It's not just WRONG to have children (under 18) give written statements to the police, but I am fairly certain that it's against the law! Especially if they are impaired to the point of needing special care!

Jen, you are a great mom. The answer to your question is this: What do you do? You keep your dukes up. You fight fight fight. But call the lawyer FIRST. The schools HAVE to provide him with an education AND keep him safe. They are failing in both respects IMHO. There is NO way that child could have been learning while fearing for his safety!

ooooh. This stuff just makes my blood boil.
