They called today to say that they will not be running Friday flights from Gatwick until later in the season and have moved our 14th July flight to 15th July,
We have booked into our new timeshare and will know be lossing a day there and having to forkout for a hotel for the last night!
Has anyone else had this problem?

should the company not pay for your extra night
I would look into this

You bet and we will back at work on the Monday totally jet lagged :surfweb:

We will write a letter requesting compensation but i think they will have a no consequential loss cluse :guilty:

I could be wrong but I thought that airlines HAD to pay out some sort of compensation if they cancel your flight these days - which in effect they are doing surely, by failing to provide a flight on the same day you have booked already ?

Does anyone know the up to date legalities of this ?????? :confused3

Hi

Thats terrible news. I think you can cancel your holiday for a full refund, but they are not entitled to give you any compensation. Have you looked at other flight companies and see if cancelling the flights is an option.

This is TCD terms

11.CHANGES BY US If we find it necessary to make a material change to your holiday before departure then we will notify you as soon as possible. A material change is for example one involving a change of destination resort, a change to accommodation of a lower classification, a change of confirmed flight times by more than 12 hours to your outbound or return flight or a change of airport (other than between Gatwick and Heathrow, Cardiff and Bristol or between Orlando International and Sanford, Gerona and Barcelona). A change of airline or aircraft type or en-route stops, a change of in-flight cabin location or facilities or upgrade benefits or where a change of airport plus transportation results in a delay of less than 12 hours will not be considered a material change. If a material change to your holiday is necessary you will be offered the option to accept the change or choose an alternative from our programme subject to availability and the acceptance of any holiday price adjustment or cancel the holiday and receive a full refund of all monies paid. If a material change is notified to you less than 8 weeks before departure then in addition to whichever option you choose to take, you will be paid compensation on the scale below except that no compensation will be payable where the change arises due to force majeure as defined in section 17.

12.COMPENSATION FOR CANCELLATION OR CHANGES BY US If we cancel or make a material change to your holiday and you accept the
offered change or alternative holiday then we will pay you compensation in
accordance with scale A in the table below. If you decide to accept instead a
refund of your holiday cost then we will pay you compensation in accordance
will scale B.

Time before departure when change or cancellation is notified Compensation for passenger
Scale A Scale B
More than 56 days Nil Nil
56-43 days £10 Nil
42-29 days £20 £10
28-15 days £25 £10
14 days or less £30 £15

*Children or adults travelling at reduced prices receive compensation on a pro-rata basis.

Terrible and this is why I would never choose to fly with someone who wouldnt pay for any inconvenience.

Hope you sort it all out.

You should have the right to cancel at no cost to yourselves.
then book with a scheduled airline.

Obis right, you do have the right to cancel but they also have the right to reschedule a flight.

I'll bet they've rescheduled though to go out earlier the day after making them within 24 hours

Tony what a shame. I do feel for you guys!

If you can't get anywhere with TCD, what about ending the holiday on a high and booking a night at one of the onsite Universal Hotels? I bet your two would love the Hard Rock Hotel :)

Might take away some of the disappointment of leaving your lovely new timeshare?

As they ahve given you plenty of notice it looks like you can either

a) Stick with it and go somewhere else for the odd night or

b) Cancel and book with someone else

Personally think I would book with someone else for the dates i originally wanted.

All the major tour operators run this clause ie 56 days out and no comp. The 56 days is when the final payment is due so once they have all of your money they have to offer some sort of compensation.

Hi guys
we have checked and we can't get anywhere near the cost of the flights we have booked so we are just going to book the Saturday flight they have offered us.
Karen, the Universal idea is a good one :thumbsup2 we may very well do that.
Does anyone know the way to get the cheapest prices for universal hotels????

We had Universal APs which gave us a discount when we booked Hard Rock Hotel. It only worked for our immediate family and not the other two families we were booking. The universal hotes are worth the money as you get front of the line access to the rides. We booked these even though we have a Disney timeshare (DVC) so fairly similar to you.

Hope it all works out for you and you have a great time.
