Sports: Deflate-Gate


I just read through a bunch of texts from a reporter in the briefing room, and listened to a bit on NFL Network. I know the Judge said not to read too much into the questions he asked, but sounds like he grilled the NFL lawyer/rep pretty good. Did Kessell too, but IMO sounds like he went after the NFL a little more. Again, we are not to read too much into the questions asked. And we're waiting.......
 
So, it seems ESPN has finally apologized for reporting false stories about the Patriots (taping of the Rams walk through)......anyone else up for eating a little crow? :D

When are they going to apologize for Mortenson's erroneous reporting that 11 of 12 balls were under by 2? I swear, ESPN has no credibility anymore.

ehhhhh, so it was really only 1 that was under by about 2 PSI.....maybe when they reported it, while pressing the "1" key the reporter sneezed, causing it to repeat, therefore showing as "11".

Nice try. When asked, Mort said he rechecked with his sources after the first day or so (I forget) and it was confirmed to him that what he reported was accurate. He was supposed to be on a show a week or so ago and he cancelled because they were going to ask him why he hadn't apologized for the reporting. I think he later issued a statement that he was sorry for something silly like being a part of the focus but didn't actually apologize or recant the bogus info.
 
Soooooo, they're back in court today and the judge hopes to have a decision by Friday. I think it'll be done by the close of business today.

Since they were only a few ticks under, and 3 of the 4 Colts balls were also a few ticks under (gee, didn't test any more than that!), I just scratch my head that this is still a "thing" and people are still so crazy that the Pat's are CHEATERS!!!

What do you think of Mora being called to testify?

I think it'll be done by the close of business today.
No matter the outcome, this will probably not be over for years. Both sides have major interest in having the legal win, as the larger matter at stake now is important parts of the CBA. Neither side wants the other to gain the upper hand in who/how the league can administer discipline.

It would be extraordinarily unusual for a judge to both overrule an arbitrator, and deliver summary judgment about the evidence/facts of the case (which is probably beyond the scope of what he's reviewing right now). The best TB can hope for is for an order to have a new arbitrator hear the appeal, and the judge put a stay on the imposed discipline (the suspension), allowing TB to play until the matter is heard by the next level of appeal.

From yesterday's Wall Street Journal:
Legal experts, though, say that despite judge’s stern words, Mr. Brady faces long odds. That’s because courts generally are very reluctant to undo a final, binding arbitration decision, even one they view as seriously flawed.

“It’s an extremely high bar,” said Peter Carfagna, a former outside counsel to the Cleveland Browns who directs Harvard Law School’s sports law clinic.

The Supreme Court made that clear in a 2001 ruling that overturned a lower court that had awarded $3 million to a retired Major League baseball player whose claim had been denied in arbitration.

“Judicial review of a labor-arbitration decision pursuant to such an agreement is very limited,” the Supreme Court wrote in its decision, which said that even if a federal court is convinced an arbitrator made a serious error, that’s not a good enough reason to overrule an arbitrator.

Well ....it's over! All the haters can toss and turn tonight. The funny thing is, now there is more evidence against Harb"liar" and some others that this was a concerted effort than they EVER had against Brady! When Feely testified that he knowingly tampered (against the Patriots I believe)and was not punished at all ...that broke the camels back. Have a great season all -it's been un-real!

Not exactly...the judgement did not address any facts of the incident, just the fairness of the process/investigation, and its adherence to the terms of the CBA. NFL has to appeal to get some power back. I'll be shocked if they don't. But the early read is that they won't seek to have the suspension reinstated during the long appeal process.

The NFL will appeal to save face (as if they have any left!) ..they've always had the power. I would do the same thing.

I doubt the owners want Goddell spending more millions of their money on an appeal so he can save face. Only to have the decision upheld.

They should reduce it to just 1 game. ;)

No he was not an arbitrator, it was an all or nothing proceeding. The judge found that the violated almost every procedure & failed to let the NFPA have access to the witness against Brady. If this was a criminal trial the ACLU would have been all over it. The prosecution gets all their witnesses but the defnese isn't allowed to the same?
