<sigh>Got our closing papers but now have a ??

We just received our closing documents on MONDAY and I sent them priority mail on TUESDAY with the big check, and I heard from the Closing Services that the points closed the following MONDAY. YAY!

However... you guys have signed a contract, right? Legally, it is a little too late for your wife to back out on the agreement now, just because she doesn't want to write the check to the closing agent.

Lawyer-ness aside - seriously, from a business perspective... the TSS runs, maintains and administers these boards. Tom is usually on here and I'm sure when he sees this he will weigh in on this... but I can say from the 2 months I have been monitoring these boards I have seen tons of folks go through with these contracts and the only person who has made any complaints here was me, and it was becuase of a missed email about ROFR notification. Tom was VERY quick to jump on it and rectify - and since that point everything has been fantastic. From a business standpoint TSS cannot afford bad press... in fact, they even give folks gift baskets when they go by the store!

Show your wife the boards, and the cities where everyone is from. We can't all be in collusion. :)

Have her check the corporate documents/information posted with the Florida Secretary of State's office. That may be an "official" thing that puts her mind at ease. But seriously - she has entered into a contract, and at this point the time has run for her to have changed her mind...

In addition to all of the above, I believe one of the documents in the closing package is a letter from Disney saying they've checked their records and their records match the contract. That's how people discover issues during the ROFR review process, I think. I'm not a realtor, but I'm pretty sure that's in there somewhere.

You might check with TTS or the closing agent and have them fax/email you a copy of that letter. I'm sure it would resolve your DW's concerns.
 
Folks, again we are extremely happy with Tom and the TSS staff, that has never been in question. As I mentioned before, DW has this uncanny knack for getting stubborn on what is normally simple things. She means well by it, but as she is not the type to go and read through a message board she will come up with her own ideas. Before reading through the threads here, I would have never considered a resale, but knowledge is power. If I had not read more about resales on here, we may never have become DVC members because there is no way we could afford to buy directly from Disney

The funny thing is, we are still looking for a home to buy. I feel waaaaayyyyy more comfortable with this DVC resale because I am better informed on it thanks to you all and Tom and Jason, whereas I have never purchased a house and I have been getting conflicting info from friends and family about the best way to buy a house. Granted buying a house and DVC are 2 different things, but I hope someone will understand what I mean by it.

I realize now that my OP came across as too negative, when I just wanted to be able to get info from someone here that would better inform my wife. We will be purchasing this contract; she just needs a lil extra reassurance. I think the link that burnsoc posted will do the trick.

Is this statement correct? I don't think so. The Timeshare Store is a sponsor but does it run, maintain, and administer this board? Please correct me if I am wrong.
 

Ok folks, the documents are signed!!! I showed DW the Orange County official records and her concerns were put to rest so we have a go. Now I just have to get the cashiers check and put it in the mail tomorrow. And then comes the wait until everything is finalized and we are in the system...

AAAHHHHHHHHHHHHHHHHHHHHHHHHHHHHH!!!!

It sounds like you're already over the hurdle, but here's some additional comfort (I bought my VWL from TTS too and couldn't be happier).

1. The Seller signed a contract that recited the status of the currently available points.

2. With your closing papers you received an Occupancy and Use Disclosure. It recites the assurance from the Seller as to the status of the currently available points and reports that DVC did not report any discrepancy in those assurances. Again, this is enforceable against the Seller not the closing service or DVC, but it does provide comfort that DVC reported no discrepancy.

3. With your deed, you will receive a title policy. The policy will insure your real estate interest in the timeshare unit (not the current status of points, but those are covered above).

4. You receive a Deed from the Seller. To issue the policy, the title insurance company had to confirm that the Seller executed a legally enforceable deed conveying title to you.

You should ask Tom if they or the closing agent had any additional documentation (like the estoppels) that they could share with you if you want more assurance.

And with any luck, you are only days away from being able to make your first reservations. Welcome Home.
