Should Disney compensate me

I would expect Disney to pay all the medical bills. It would also be nice if they threw in some tickets or something for another visit.....good PR.
The McDonald's example is perfect.....people could & do sue....for sillier things.
I wouldn't sue but I would expect all medical bills to be taken care of.
Seeking some sort of legal advice would be the way to go.

Lol. I cant get over some of these posts. Yeah, Il just tell my 2 boys to "Rub some dirt in it and walk it off!" or I woulda told the kid: "Only hurts till the pain goes away, I gots some zebras to see come on!"

My goodness they are kids. They are in pain. Is it as traumatic as God forbid cancer? No. Have a heart. I like a little TLC sometimes.

I guess I don't get it because I live in Alaska. Falling here is one of those things that you expect with the snow and ice.

Did the kid fall and is now in a coma with a traumatic brain injury, no.

If you slip at your neighbors house are you going to sue them??? Probably not, but with Disney people see $$$$ signs in their heads.

Don't get me wrong, I'm glad the kid is not seriously hurt. But, wow!

On the 26 th June me an my family went to Orlando for our first vist. We bought what is called the one ticket for the 3 of us costing over a thousand pounds.on the second day there we went to animal kingdom and were having great fun until this happened. The rain had started to rain heavy so we went on a little train that takes you to rafikis planet when we got to the platform at other end my son slipped on the platform and screamed in agony so much so that the pain made him sick.when I pointed to the guard on the platform that my son was in pain his response was that there was a wet sign on the platform as if to cover himself rather than be concerned about my son.also 1wet sign on that large platform is no where enough as we could not see it from we got of the train.the guard then told me my son would have to move so he could fill the train.I told him my son would not be moving until he was ready.it soon became clear my son had hurt his wrist badly and a ambulance was called. 30 mins later it arrived and took my wife and son to the celebration hospital. At this point when the ambulance arrived (30 mins)was when we first saw a manager I made my complaint and headed off to the hospital where it was confirmed my son had a buckled fracture to his wrist and was to have a cast on his arm for the rest of our Holstein.which meant he couldn't go to his fav parks which are the waterparks.

So sorry to hear that your son was injured while on vacation. Thankfully he did not have an appendicitis instead and have to be admitted to a hospital and have surgery during your holiday. As far as everyone's comments about parental responsibility, I have to say I tend to agree - parents should be in charge of their children's safety. As an added bonus Disney has a recorded voice that I can almost hear in my sleep at night which includes; "take small children by the hand..." I do not know if this recording plays at the end of the train ride in AK

If you get hurt on a business's property, I would assume they would always pay the medical bills. I am not saying I agree, but I think this is the way it is. That's why these companies carry tons of insurance.
My son broke his wrist at a soccer game.....we never asked for anything, but were told they had insurance to cover the costs.

Personally, I'd be shocked to hear Disney didn't pay.

I personally am shocked at some responses. Maybe this person simply wanted an opinion. Yea, the kid isn't dying from cancer, but he was still injured on disney property.

Why teach your kids they need to be compensated in some way for every thing that happens to them???

People need to be careful not to wear their "Disney can do no wrong" hat too tight in situations like this. It is admirable that so many people here have the "people should be responsible for their own actions" attitude, and "accidents happen" viewpoint. If only our court system had more of you sitting ing the jury box. But the truth is, things like this happen every day in supermarkets, movie theaters, buses, office buildings, sidewalks and dwellings and the injured people make claims, file suits and obtain compensation. You may not think it is fair or agree. But simple accidents do result in compensation. So I think it unwise to counsel a person who is obviously not from this country that compensation is neither warranted nor possible. You don't really know that.

Well, most of the locations you listed/I bolded are indoors. Even then, the owner of the building has to be considered to have reasonable notice and control over wet, slippery, etc., areas. If you pour a bottle of oil on the supermarket floor, and five seconds later I come around the corner and slip in it, the store probably isn't responsible.

Now, the sidewalk is an interesting comparison. While it's true people sue and win for injuries incurred on damaged walks, I don't think anyone has ever won a suit based on a rain-soaked sidewalk (not even where I live, where sometimes the ground is so saturated the rain sits a couple of feet above the sidewalk).

My boys play football here in Missouri are catchers in baseball and Im sure they are hit and fall as much as they do in Alaska. I dont agree at all with the compensation they were asking. Where you got that in my post........?.....?.......?

Ok, 2 different answers to this question.

If you're asking if you could win a lawsuit, I would assume yes. To me this is equivalent of people suing McDonalds for having hot coffee. Coffee=hot and wet rainy weather=slippery ground. Both things that should be obvious, but...

If you're asking if you should from a moral standpoint, no. Clearly you already agree with this or you wouldn't be asking us to tell you it's ok.

But while both are obvious, coffee temperature is controlled by the vendor. Walt Disney World may be The Most Magical Place on Earth, but as someone indicated above, even they can't control the weather.

You know, it's not so much that i want to argue with anyone, i just love a good debate. It's makes people think, and pull their heads out of the tv or whatever they were doing.

WOW! I am shocked at some of the comments here. This is the same board that people get mad and want a free meal if they get bad service.....want a free night if they walk in their room and find dust on the lamps and a bathroom that was not cleaned properly...or will throw a FULL FIT if their KTTW was not coded properly and they get to a store, park or restaurant and find they do not have charging privelegs. But yet a young child slips and breaks his wrist which meant they could not go to the water parks which they had planned to do and what rides can you do with a cast anyway but THEY are wrong to wonder about compensation??? And where does it say anything about wanting to sue Disney????

TLC? Fine. Compensation? No - and yes, I know you didn't say anything about it, but it's the gist of this thread.

First off, I hope your son is feeling better. Second, I do not believe you have the right to compensation for this.

Note: This is a fictitious story, but I find it to be similar to what the OP is asking.
Let's say I went to Target today and got myself a shopping cart full of makeup; on the way out, I noticed it was pouring, so I got myself a cup of coffee to go. When I left the store, drinking my coffee while thinking of how awesome I am going to look in the makeup I bought, I stepped off the curb the wrong way (especially because it was slippery from the rain) and end up falling onto the handle of my shopping cart, the hot coffee pouring over my face as I hit the pavement. I have to go to the ER for first degree burns and a broken jaw. In this example, would it be logical for me to sue Target for something they cannot control, like the weather, my lack of observation of the curb, and the coffee just being in my hands when I slipped?

Accidents happen all the time, and it is simply the luck of the cards one of them happened while you were at Disney. Sure, the CM could have been a bit nicer about it, but he could have also seen people ignore the fact that pavements are slippery when when and end up slipping on the pavement.

Maybe reimburse their water park passes and comp new ones or something maybe. But thats it. Heck, maybe throw in a free character meal.

I too am sorry that your son was hurt, but I also agree that to expect to be compensated for it is, well in a word Greedy. Previous posts about Disney having insurance for these types of incidents is correct. There should be a policy in place to cover medical expenses (regardless of liability - in other words, your son was hurt on Disney property so the insurance should cover medical expenses) What exactly are you asking to be compensated for??
