Sad news

It always amazes me when Disney does this. They contract out to Mears...their name is all over the darn buses. Come on Disney...basically it's your bus!

Don't get me started!!! I know Bostonians drive like nuts, but down in Florida?? The roads are basically straight...no one used directionals, they hit their brakes at the last minute. They drive way too fast. By the time I get home from two week stays with my family north of Ft Lauderdale, I'm driving too fast, slamming on my brakes and never use my directionals!!!! Someone should have built curves and hills into the Florida roadways!!!

Yes, Disneys name is all over the busses, but, they are owned, operated and driven by Mears, not Disney. I can see why they put that up quickly, saves bad press and rumors. It is a shame they have to do that.

Hey, I am from Mass and I learned to drive in Mass. :) All you said about the Floridians is absolutely true. But, I still use my directionals, don't slam on my breaks and NEVER stop in a travel lane. Forget driving fast, almost impossible in Orlando. I-4 is a slow moving parking lot.

Why? She was sitting on the bus with her children and tweeted while waiting. How could that possibly bring a lawsuit?:confused3

And, while your post sounds "PC", I don't agree with your statement. You're telling me you'd be happy to be sitting on a bus waiting for a couple of hours? All because someone did something stupid that cost them their life? The woman was stopped in the travel lane, for whatever reason. If her car stalled, she shouldn't have been sitting in it. If she just stopped, then, that's just crazy. Either way, it's not the bus passengers fault and while they can feel for her and her family, they are allowed to have their own feelings about the situation.

How could that possibly bring a lawsuit? traumatizing her children.
I am rarely, if ever, PC. You don't have to agree with my statement. Of course I would not be happy sitting on a bus for 2 hours, but, I would be understanding of the situation. No traffic was allowed near this accident, so, how, pray tell, would any alternate form of transportation been possible?

Why is there a lawsuit of a person sitting on a bus for two hours posting on social media that they were stranded??????

It was not the two hours, it was the woman stating her children were traumatized. Sea World paid off for traumatizing a child as his parents allowed him to watch that trainer get drowned.
People sue for the most asinine reasons. One woman sued because she slipped off the sidewalk while eating ice cream claiming that she did not realize the curb ended because it was not painted.
Another sued for whiplash on the "speedway" at Magic Kingdom.
Disney has deep pockets.

It's called gaming the system, in this case trying to extract a cash settlement.

Worse yet, people who were outside passing by have been known to get on board (figuratively and literally).

"Walk right in, set right down"

Then pull out an iPhone and start tweeting about how they are going to sue.

"See something, say something." Guests seeing shenanigans such as the preceding should pull out their own iPhones and photograph the surroundings (including the bus interior) to make it easier to identify miscreants.

A small number of potential lawsuits could be averted if Disney quietly honored late arrivals for meal reservations, say at Le Cellier or 'Ohana, by guests delayed on a bus and also quietly saw guests home with some added pampering if it was a Magical Express bus back to the airport.

Thank you Seashore, some people just don't get it.

I have to agree; this is splitting hairs. So you want the credit and advertisement for the bus and service, but can't take accountability for the driver or the safety of the bus?

The drivers work for Mears, not Disney. The safety of those busses is on Mears, not Disney. Wy should they be held accountable? They pay a hefty price to lease those busses and the advertisements that go with it.

Disney gains a lot of advertising and marketing benefit from ME, but the fact remains that they don't own or operate the service. Why should they assume legal responsibility? Would you want to assume legal responsibility for something you didn't do and weren't a party to...legal responsibility meaning you were liable and might pay not just money to any plaintiffs, but possibly fines and penalties from regulating agencies? And if you're Mears, what incentive do you have to be accountable if Disney will step in and take the blame when something goes wrong?

We unfortunately live in a very litigious society and it doesn't surprise me at all for Disney to clarify this immediately. Heck, if anyone had ideas about trying to unscrupulously benefit from the accident by suing, they might actually reconsider when they realized it wasn't the deep pockets of Disney they'd be going after.

1) It was most likely the police department that required the guests to stay on the bus for a period of time. They had to make sure the scene was safe and cleared. No one would have been allowed to leave the scene until the police gave the okay. I am sure once they did, Disney transported the guests where they needed to go.

2) Most likely the quote about the bus being Mears and not Disney was either taken out of context, taken from the website, or taken from a media packet. Even if it was not, there is NOTHING wrong with the statement. Especially since there is still an investigation that has to be done and limited information (especially at the time of the original "quote").

3) Maybe it is because I have taken too many business law classes (and health care law), but that woman's tweet just screams that she is planning to sue. Nothing like setting up for a lawsuit with an emotional tweet about a "traumatized" child.

Traumatized child and adults wouldn't you be traumatized if you where on a bus that hit a car let alone killed someone?

What do we care if the people on bus sue Mears.

This is reason why businesses carry insurance.

Not sure I would be traumatized, upset yes. Would I sue because I suffered being upset, not on your life. Why would any person of reasonable conscience sue for that type of misfortune? If I had been hurt, then I might expect their insurance to cover my medical bills, but, for being upset, no.
What do we care, well, perhaps we don't and are just discussing this. Perhaps some of us don't like a litigious society where no one cares and will sue at the drop of the hat for any reason.
I doubt they carry insurance just because they might get sued, there are other reasons.
