I am just curious- If Disney exercises their ROFR what happens to the commission? Do you have to pay Disney the equivalent of the commission you would have to pay the timeshare agents. Or does the seller get the full asking price? I know that it is a disappointment for the buyers but what about the sellers?
 
The deal is exactly the same but Disney is paying for it instead of the prospective buyer. The seller gets what ever amount they agreed to less the commission they would have paid the broker regarless of who was buying it. Bottomline, the seller does not lose anything due to ROFR.

I am not sure this is true. The agent loses customer satisfaction, which may cause additional business to go directly to DVC resales. The broker could also lose future business to another broker if the buyer feels the contract was priced innapropriately.

Just curious- is it possible to sell directly back to Disney, without using a broker, thus saving the commission?

I see what you are saying, but....

1) I was referring to the money from THIS sale, not ones "down the road"

2) Customer satisfaction is not really lost...remember, agent's true "customer" is the one paying his/her bills...the SELLER, not the BUYER (I think a lot of people who go through resale forget that the agent is not really working "for them", but for the other person in the contract).

and

3) I feel very strongly (as someone who watches the resale market for add-ons constantly) that "who you buy from" is driven more by who has the contract you want, rather than by "who is the most knowledgeable". Buying into DVC is "not brain surgery", and if you are a knowledgeable buyer....you pretty much stipulate what you want anyway. I had a great experience buying from TTS...but, I have NO qualms about going with someone else in my next purchase. And, if my contract had been snatched by DVC...I wouldn't have blamed the realtor. I KNOW if I offer $89 per point...DVC is not going to take it, and really...anything less than $89 is one big gamble (to a lesser or greater degree).

Not as of yet, but I think that option may be coming if DVC continues its current trend.

While it is true that Disney does not buy back contracts except through the ROFR process, you do not need a broker to sell your contract. Those who do not wish to pay a broker are free to find their own buyer, negotiate terms and present the deal to Disney on their own.
