ROFR question

Like any real estate negotiation, the buyer can negotiate how maintenance fees are handled (e.g., buyer pays 100%, seller pays 100%, or some in between where buyer pay proportional to how much of the year is remaining). Personally, I think the latter makes the least sense -- is a two-month old point worth more or less than a newborn point? Do any of the brokerages require it be handled a particular way, e.g., TTS's website states simply that the buyer pays MF on bundled points. Do they enforce this or can buyer's specify otherwise in their offers?
Obviously everything is technically negotiable, however, the major ones that deal with DVC have a standard set point which is "you get the points, you pay the fees", they will tell you this as a buyer or seller., I've had discussions on this very topic with at least 2 of them. I also had a broker of a company that's not one of the big players call DVC when I brought this to his attention and he communicated with me that my stance was correct and his previous understanding not, because of the information that DVC charges on a calendar year basis and not a UY basis. Obviously it doesn't come into play except on buying and on either selling or the end of the RTU.
 
Thanks. The question I wonder about is how "not good" is "not good". $6/pt? $8? $10? I'll be in the same boat if my contracts end up closing (awaiting seller signatures so I haven't posted to ROFR thread). OP and I will have to hope that there's still some decent value in Dec UY points come late September.

I've got a DEC contract that was sent to Disney last week, so I hope to have it in my membership by next week. When it arrives those points should have 3-4 months left on them, I'm going to offer the points up at $10/point.

Just recently I got rid of some points for $5/point that only had 3 weeks left on them; I hadn't even counted on getting them.

So try for $10 and if you don't get rid of them within 2-3 days then drop it down another dollar.

The problem won't be that people will want the points for cheaper, the problem will be finding availability for those people that do respond to you.

Whoa - I'm glad to hear you caught that! My broker told the Sellers to bank even before I asked. In fact, it's written into the contracts -- you should request the same, if the contracts aren't already signed. It shouldn't be a problem --- presumably anybody selling a contract with three years worth of points, including one year with a very short fuse, is not willing/able to rent points, so they are likely very relieved to have you taking the contract off their hands.

I'm still waiting to hear if she was able to get seller to bank 2011 points. Thanks for advice! Normally I ask about but I was on the fence about purchasing this one for about a week and then when I decided to jump on it we were all about hurrying to move it along as fast as we could for the 2010 points and overlooked the 2011 points! I went over all my other contracts to make sure all points were where I thought they should be and everything looks great!

Okay the people hadn't responded to my request to bank the 2011 points (I only had to the end of the month) and since it's been a week and half and they still hadn't even signed the contracts with the 7 day time frame I'm moving on from the whole deal. I don't think I could get rid of 830 points in only a month a half and that's if they stopped lagging. I felt bad for the agent but since she's handling several other contracts for me she doesn't seem too bummed about! Has anyone else ever had this happen to them? I felt it was best to move and look for someone whoe felt more interested in selling!

IMO, it's not a good thing when, from the start, sellers are MIA...now, it could be that they are on vacation or have some other reason for being out of contact...but with that banking deadline just days away, unfortunately, you are not in a position to wait.

Thank you! I do think I did the right thing! Could tell broker kind of wanted me to hang in there a little longer but even she admited it's always something with the sellers. Feel bad for them if they didn't bank those 2011 points. I kept trying to get a message to them they need to bank no matter what. All I could do:)

I'm sorry your deal didn't work out. It's so frustrating to see these contracts with points that are going to expire. Unfortunately, many sellers do not realize the true value of these points or the hit that their contracts will take if they allow them to expire. In that case all you can do is walk away. It is still a pity though. Better luck on your next negotiation! :)
