Restraining Orders????

I need to know how to go about getting one....under what circumstances can I get one particularly dealing with harrassment? Any info that anyone may have would be great.

I have tried to do a search for restraining orders in Florida and I am not coming up with anything!!

Please help.....anyone!!! Thanks
 
Sorry that you need one. I hope that you are able to get all the info you need and get everything taken care of quickly.
 
The laws vary state to state. Your best bet is to call your local police agency. If they cannot be of help, they should at least point you in the right direction.

Thanks everyone, I believe I will be making a phone call tomorrow to the police station!

Dan- i'm sure that link is great but about 95% of the information went right over my head!! lol Thanks for the help though....I have a question, do you ever sleep???? evey time someone asks for info you are right there to help!!! Thanks
 
Went to google..

Looks like you go to the civil division of the Clerk of the Court and fill out a petition request. Then a judge reviews the petition. If the judge grants your request, you will have a temporary restraining order until a hearing can be held. At the hearing both parties will be there, and the judge will decide to continue or dismiss the restraining order. If they are not a spouse or someone living with you, there must have been 2 incidents within the last 6 months. (atleast for the county I pulled up)

Try going to google.com and putting in something like, restraining order florida ---which is what I did, or even adding the name of your county/municipality.

I got one against my mother. She left me a message saying she was coming to burn my house down. The judge never listened to the message. He took my word for it (the police were involved though) and granted me a 2 year restraining order. I am able to renew it without provocation if I want to.

In our state, the hearing is only held if the person you are getting the order against wants a hearing. That person can dispute it and then a hearing is called. Luckily, my mom didn't dispute it.
 
MosMom- i am sorry you had to get one against your mom of all people. I am looking into getting one against my ex-h, he is constantly calling and accussing me of things and trying to keep a hold of me even thought we have been divroced for over 2 years!!
