Rescinding DVC Direct Contract

Hello all,

Just wanted to let everyone know about my experience in cancelling a Direct Poly contract w DVD. Per the directions on the contract it says you can cancel via FAX or certified mail with return receipt. I did both, but could have probably just FAXED. I received a call the next day confirming they received our notice of cancellation via fax, and that as long as we hadn't used any points, our refund would be processed within a few weeks.
 
To DVD it's just another day at work, I was told that the guides rescinds are tracked. Apparently they put refunds on the back burner.

Well, I rescinded Last Friday, 2/19. I will let everyone know when the charges are reversed.
 
It's nice to know they made it easy and didn't make you jump through any hoops or listen to another sales pitch.
 

Well, I didn't know the process until I researched it. I called MS to rescind and they suggested that I call our Sales Rep...Glad I didn't.

They don't have any choice under Florida law. If a consumer files the rescission notice the right way within 10 days, they are compelled by law to cancel the contract. There is no option with this important consumer legal right.

There is also no reason why the refund should take a matter of weeks, and I suspect that information was just trying to cover every possible delay. Member Admin simply needs to verify that there are no outstanding reservations on the account and issue the credit. If OP paid by credit card, there is no reason why that should take more than a couple of business days.

Nobody ever has any obligation to contact their timeshare salesman in a situation like this, and if MS told OP to do so, they were wrong. They should have given OP the correct info -- how to file the proper paperwork or to contact Member Administration for assistance.

The problem comes in when purchasers don't know any other point of contact but the sales organization. If a purchaser contacts sales, obviously they will try to save the sale -- that's their job. DVC is generally pretty ethical with their sales practices, but not all timeshare companies are.

This kind of thread is a perfect example of why forums like the DIS DVC boards and TUG are so important.

I agree. Disney says this about all refunds - and in some cases I do feel they are not refunding as quickly as they should. I would hope that the deposit is refunded within a couple of days, not a few weeks. If they can take the payment in a few hours they can return it in the same amount of time.
 
Admittedly, I had Pixie Dust clouding my vision....it cleared after viewing this forum and actually reading the contract. I will call Membership Admin tomorrow if the refund hasn't processed.

I'm not sure how long they usually take but a couple of weeks (or up to maybe 3) for a check and longer if paid by CC is reasonable.
 
I finally had a chance to check and my refund posted to my credit card on 2/29 ten days after they received notice. Not bad, I heard by law they had 20 days...
 
Disney is probably a little different than pure timeshare companies such as Wingate...they have a brand that is based on positive customer experience, and hope to still retain cancelling customers in their multiple other businesses besides timeshares.
