Resale with the Timeshare Store Question

Hi All-

I hope someone cah enlighten me about this question because I have one VERY UNHAPPY husband right about now.

We purchased a resale through The Timeshare Store in July. It is a Feb. use year and the contract said that the 50 points would come available in Feb. 06. I called and booked our trip for next summer back in August at the 11 month window, but called to change resorts now that we are within the 7 month window. When Disney changed the resort for us (yeah!! OKW was available) they informed me that the previous owners had used all of the '06 points and what was actually allocated to us this month were points that had been "transferred in" (from where I don't know?) and were really '05 points, not '06 points like our contract says. Now, this wouldn't be a big deal, except that we are not using all of the points that we would have because SSR has higher points than OKW and I was going to "bank" the unused points. Disney says "NOPE, can't bank them...they are already banked" I went over my contract with the ladies at Disney and they tell me that their records of this contract are not what my contract says. :confused3
Jamie at the Timeshare store is looking into this mess for me, but my DH is SO PISSED right now. :furious: We stand to "lose" points because we are already going for 2 weeks and he can't take any more time off of work than that.
Has anyone ever heard of this?? Could the previous owners just pulled a fast one on the Timeshare Store people? With all of the great things everyone has to say about them, I just can't believe that they would try to pull a fast one on ME, KWIM?

IF the contract said "50 points would become available", they just did.

IF the contract states "50 FEB 06(non transferred) points would become available", I would be very PISSED.
 
When you sign a contract with TSS, as I did, it specifies how many points you have to use in the current year. I would think they would try to make this situation right for you by getting money from the sellers; otherwise, they do not seem to have fulfilled what they promised in the contract.

8.SPECIAL CLAUSES: BUYER TO RECEIVE 50 POINTS FOR THE 2006 ALLOCATION FORWARD.


Doesn't this mean that the points should be 2006 points?

I think it does, but I am not a lawyer.

FWIW, I think you should give Jamie at the Timshare Store a chance to figure things out before you make yourself too crazy over it. Hope it all works out for you.

Calm down everyone. The Timeshare Store is NOT trying to pull a fast one on anybody. Give me a chance to look into it. I'll post again when I find out what is going on and what we can do about it.

I know that Jamie is working on this and she has been SO KIND! I surely don't think that this intentional, but rather just a simple mistake. I know y'all will do what you can to fix it. I'm also trying to get through to Disney to "waitlist" for a bigger room to use up the banked points. (I'd LOVE that!) I was just hoping that last night when my Dh was all :furious: about it that someone could tell me something so that I could calm his :crazy: ness.

I thought part of the delay of time after you pass ROFR was for DVC to "verify" that what was stated in the contract actually was correct. From what I understand (I have bought resale about 8 times), resale agents have VERY limited access to DVC's records. Usually, resale agents ask me to "fax" an activity statement to them when I list a contract for sale. However....these can be VERY confusing, especially if points have been transferred in/out.

While I do think you have a right to be mad....I think your real "beef" is with the seller. However, some sellers really don't know what they have. And, cm's at WDW can't always correctly read MY activity statement when I call in.

So...either your contract was "padded" when it was sold, or the sellers made an honest mistake about which points had been used, or they didn't realize where the points came from made a difference. Since most sellers make more money off of "stripped" contracts (especially the small ones) than full ones, I doubt anything "deceptive" had gone on here. It's just a matter that EVERYONE has a hard time reading DVC's activity sheets.....even DVC themselves.

I'm not sure what your recourse is, but I hope it all works out for you.

I have a contract up for sale now at the Timeshare Store and I know that they got a points activity statement from Disney before putting it up for sale - I would think that the activity would appear on that and that maybe Disney listed it incorrectly on the statement? I'm sure the Timeshare store will get to the bottom of it.

Here's the skinny folks-WE GOOFED UP!!!-The points activity was misinterpreted when we received it. Disney failed to catch it at their final review, so they GOOFED UP!!! Now what happens????

If Donna is unable to get her upgrade she has requested from MS, we will replace those unusable points into her 2006 account. So all will be well!!

The points to transfer come out of Tom's personal stash.

HAPPY DAYS ARE HERE AGAIN!!!!

And that dear friends is why I use the TTS!

While I'm suprised that the TTS personnel made an error, I am *NOT* suprised that Tom would publically admit it, and make it better!

Every business makes mistakes - it's what they do afterwards to "make it right" that separates the winners from the losers.

It is great that there are respectable honest business people out there. You have just reconfirmed why I purchsed 2 resale contracts from you and reffered my folks who also purchsed from you. I'll be sending my BIL in the not to distant future! Thank You!!!
 
This is why I always recommend to people I meet that are interested in buying a DVC membership to deal with the Timeshare Store! :cheer2:

Now THAT'S customer service! Jamie called me just a bit ago and I was going to post how AWESOME The Timeshare Store has been about all this, but I see that Tom beat me to it! :thumbsup2

Y'all, I don't think that Tom should have to give up his own personal points to make this right, but I am SO IMPRESSED that he is willing to do so. If we are unable to get our bigger room from waitlisting, I'm trying to talk DH into a 3rd honeymoon to HH before the points expire in January. :rotfl: (We just came back from there 3 weeks ago.) He says that "We'll see what happends. Maybe if we can't get the waitlist we'll go." :cool1: :cool1: Tom, you just might have gotten me yet another unexpected trip HOME! :thumbsup2 Who can complain about that??

Anyway, I know where I'm going the next time I add on points, yep...The Timeshare Store...without a doubt! :cheer2:

We're new to DVC and bought at SSR through Disney, but when I get my first case of addonitis I won't hesitate to use TTS. Tom showed he puts his money where his mouth is and that speaks volumes! Best Wishes!
