Hi.

I've got a question about resales.

Say a person has an original contract of 150 points and then did an add-on. Could they sell the original contract, but keep their add-on? Does Disney require them both to be sold if the original contract goes up for sale?

My husband's company just had a round of lay-offs. Luckily we weren't hit this time, but it scared us. We'd hate to have to give up all our points because of a job loss, thus my question above.

Add-ons are considered SEPARATE contracts. You therefore could sell the original contract and keep your add-ons. Of course, if you only had 25-50 points in add-ons, you would be very limited in your use of DVC (though you always could rent additional points). There is not a large resale market for the add-ons because commissions are so steep as to make their resale too costly for the seller; to sell your 150 points via a broker would probably cost you $1,000-$1,500.

Actually if the add-ons were small and purchased directly from DVC, then they are not considered separate contracts and cannot be sold separately (unless they are at a different resort I think).

While I don't know for certain, I would assume the add ons are separate contracts legally even if DVC treats them as single points. They would have to have a separate deed. Why else would there be recommendations to buy two 150 pt contracts instead of one 100 point contract. You'd need to check with DVC directly to be certain but I suspect you could do this.

All add-ons are separate contracts with separate deeds. You can sell your original and add-on separately as they have separate deeds and thus are not part of the same real estate interest. The practicable barrier to selling a 25 or 50 point add on is as mentioned above the potentially prohibitive costs of sale as brokers tend to have a minimum commission of $1,000 or more regardless of sale's size (although they might negotiate otherwise).
