How does a renter protect themselves against a member canceling the reservation after payment has been made but before the rental period begins?
 
If the renter is "reputable" he/she would surely have a simple contract made up to prevent things like that from happening. I have rented on several occassions to take my in-laws along and the OP has always provided me with a contract that "PROTECTS" both of us.
 
If you rented from me (I don't have any points so this is for illustration only), you would have an agreement, my name, my address, my phone numbers (home and cell) and my e-mail. I would also suggest you read as many of my past posts as possible to get to know me and see that I know what I'm doing. I think it is up to the renter of the points to make you the renter feel comfortable. If you don't feel that way, then don't rent the points.

When I have rented points I have a simple lease agreement that I use. Some of the items are:dates of the rental, amount agreed to be paid,tennant can only use the rental in accordance with the rules of the resort, landlord agrees to pay the maintance fee and utility fees of the resort, tennant agrees to maintain the unit in the same condition from the start of the lease.
These are just a few of the items covered. I think it gives "peace of mind" to the renter and landlord.

Also, I require half payment upon signing of the lease and final payment when the reservation confirmation letter is received by the renter with their name on it.

I think most everyone renting points are very reputable and try to do their best for those renting points. After all this is a vacation and everyone wants to enjoy WDW.

to a certain extent, this is the answer.

Despite contracts and phone numbers, if you are cheated your recourse would be small claims court. Its unlikely you and the person you rented from would be in the same jurisdiction and you'd be able to collect.

Few people who rent through here are cheated, but it has happened and you will have little recourse.
 
The bottom line: You can't prevent an owner from cancelling your reservation and keeping your money if he/she chooses to do that.

As the others have mentioned, there are some things you can do to increase your chances of finding an honest and trustworthy person. There will still be some risk involved. If you can't live with the risk (and some can't), rent from Disney or a TA. Saving some money is not worth losing sleep or worrying yourself sick.

It is great to bash those mean owners all the time but how about the renter that steals hotel property and the owner is left with a bill as they are responsible or doesnt show any respect for hotel property and then the owners maintanance goes up?
 
That happens too. Renting is not a risk free transaction on either side.

Just wondering where you are getting this from? Is there a thread somewhere that someone started about a problem renting from the Dis boards? Or is it just the general questions that potential renters ask regarding the owners integrity?

For me, if I see someone asking a lot of questions about trust and getting ripped off, I simply would not choose to rent to someone like that.
It does indeed take trust, but the hassle of a nervous renter is simply not worth it (for me). :wave2:
 
I don't have a contract but a renter can see I have been on the boards for a while and if I am going to continue renting why would I ruin my reputation and rip someone off. I give my address phone # and cell and they can call any time even if I wasn't going to rent I wouldn't steal anyone's money I couldn't go to jail I would die without disney

Thanks for being nice! I can usually figure out the abbreviations, but was running a little slowly reading this :crazy:

I have yet to hear of any problems with a points rental where someone was "ripped off".
 
I think most folks are pretty cautious when they are both renters and owners. I agree, Tor, we have yet to hear of a problem on these boards where someone had their reservation canceled by an owner. There was a report once of someone who had rented points from someone who later sold the contract. That meant that all reservations by the original owner were canceled by Disney at the time of sale. I don't recall that those points were rented from someone on these boards though.

Also, remember that if a member cancels less than 30 days out, their points go into a holding account and become far less valuable. Although this wouldn't help you recover your money, you can call 29 days in advance and check your reservation, to be sure you will have a room when you arrive.

I have rented out my points once, and I used a written contract. I also gave the renter my ebay info, so he could check my feedback there. I think the longer the person has been here on the DISboards and the more forms of reference they give you, the lower your risk.
 
We just rented points and everything went very smoothly.

I must admit I was a bit nervous at first but figured that we were not spending thousands of dollars and it was worth the risk.

Ultimately it worked out for both of us which was great.

I just kept thinking if someone owns DVC, how bad can they really be?
 
Yes, i do recall someone ( i cannot disclose their name, but dont worry they are no longer a member here or a dvc member) about 2 years ago renting points out cheap, money was sent to this person by several members and nothing in return, this person wouldnt return any emails or phone calls.
It turned out that this person didnt pay their dues or made payments, therefo DVC repo his points. This was the only time i ever heard of someone renting points and then disappearing with the members money.
But i have read posts and experience renters not sending money, backing out of the "already made ressies" changing their minds on the dates, leaving our points in distress, ending up in an holding account, losing points, renting at a very cheap rate just to use them before they expire, ending up as reservation points , taking unplanned trips to use the points. This happens
way more times then one person renting out their points and not fullfilling the ressies. There are risks on both sides of renting, just make their is a contract, and you both feel comfortably with the transaction and remember dvc members have restrictions and rules to follow when using their points for ressies not like making ressies thru wdw and you can cancel up to 5 days of arrival, after 5 days you lose your deposit and pay the bal. when you check in. Dvc members cannot guarantee non smoking rooms, or a non HA room at least thru wdw you have recourses. Ask questions when renting and DVC members make sure you want to rent out your points even if that means your points end up in holding , etc.
