Renter Problem Advice Needed UPDATE Post 64

You could probably wrangle around the legalese until the cows come home---and if it comes to it, until some lawyers have enough in fees for a very sizeable DVC contract of their own.

The simple fact is that if someone staying on a reservation made with your points skips on a bill, you won't be using your points until someone makes good on that bill. At that point, you can pay up, or you can sue Disney to unfreeze your account, and if you sue them you might even win. Your choice.
 
I think the key words in the Public Offering Statement is "acts and omissions". The member is responsible for any acts and omissions of their leasee, rentee, etc.

I would thing that failing to pay a bill would be an omission.
 
The big difference of opinion I see here is between what some have been told (either verbally or in an email) the policy is, or what some think the policy should be vs. folks posting what has actually happened.

Regardless of anyone's opinion, there have been several documented cases here on the DIS where the owner was, IN FACT, held responsible for financial obligations of a guest.

If I were a prudent owner considering whether to treat a relative or rent a reservation, I would give more weight to what has actually happened than to what someone thinks is supposed to happen, or what someone else thinks should happen.
 
My renter contacted me and told me she had refuneded the sub renters payment.

I agreed for the sub renter to contact me for us to work out a solution together but my renter advised she had called her doctor to explain the situation to him and see if the surgery could be brought forward to the the day after. My renter told me she would find out the following day and if I didn't hear from her she will be in surgery and contact me the following day.

Its been just over a week now and I haven't heard a peep from my renter. I did send her a message yesterday but haven't heard anything back yet.

Now if my renter has the dining plan booked and doesn't check into the rental would the charges still be payable if it hasn't been cancelled previously?

This is the first time I have rented out points and I expect it to be the last its an absolute nightmare and not worth the hassle :sad2:

Hopefully everything went well and they are going to use both parts of the reservation. I would make that assumption unless they notify you otherwise.

The renter could not have signed up for the dining plan on their own. Either you arranged it for them, or they have no dining plan. MS will not make DDP or any other kind of arrangements on your account without speaking directly to you.

I think she would have to check in to be charged for the dining plan. If she doesn't check in, the reservation is cancelled.

Typical of Disney, that is not always true.

We had a renter add the DDP at check in without my knowledge. The Front Desk canceled the original reservation and our points went into holding, Then the Cast Member borrowed points for the new reservation. When I complained to DVC Management, I was told that they couldn't fault the Cast Member for trying to make a Guest experience magical. :scared1:

It seems to me that DVC Management should have taken the points out of holding to replace the borrowed points. No one but the member should have the right to make that change.

I should have continued the story.

They did finally fix our points but it took a couple of weeks and several phone calls. If they stuck to the rules, I wouldn't have had to deal with any of it.

I did ask my renter if she still planned on using the dining plan for the second half of the reservation but received no response.

I am worried that if she does not check in thet the dining plan cost will be payable my me.

If she has not responded to you concerning the second reservation, I would cancel the DDP for the first one. She is not forthcoming as a renter, and let her know that. You have 48 hrs. to cancel DDP....if you are concerned, cancel it.
 
I think the DVC member would only be responsble for damages to the rented unit or smoking rules nt personal charges. Disney offered to let the renter charge on the room key. :confused3

Of course they did. If you are the person holding the reservation (renter or member) you have charging privileges on your room key as long as you submit a VALID credit card. Disney will always validate the credit card before allowing charging privileges. Also, the member would never be responsible for any personal charges a renter was not able to cover regardless.

Has there been a practice of people renting and then reselling/re-renting for a higher price either here or on E-bay or other outlets? Quite a few years ago I had a sense I might have been "played" by a renter who came across as a fellow member and DVC'er. Or I'm I just paranoid. ;):rolleyes1

I would think it would be impossible to "sub-lease" the reservation... only the member can make changes to the names on the reservation..

I would not think so, but you could call Member Services and ask them to be sure.
If she has not responded to you concerning the second reservation, I would cancel the DDP for the first one.
Unfortunately, if the original agreement included signing up for DDP, dropping it would mean that the OP did not meet the agreed-upon terms. As the OP has the renter's money, I would not drop it unless the renter agrees to do so.

Do we know that the renter signed an agreement that included DDP? I don't think there was a contract at all, but I could be mistaken.

:scared1:I would be worried! It is very kind of you to go through all this work, and a shame about your renters medical problems. That said, it has been over a week she has not communicated with you. This seems to be a see saw, I would try to contact her and at this point tell her you need to hear from her within 48 hours.
I am sorry you are going through this. In 12 years I rented for the first time last year. It was a wonderful smooth transaction to a lovely family. We keep intouch via email. Stories like this and some others I've heard is what makes renting scary. Good Luck!
