Purchasing Sold Out Resorts Direct

When I purchased my direct, the points were banked as soon as I called member services into the following year and I saw it immediately on my dash board. I would call your guide today if you February.

I purchased my most recent direct contract on November 28th (paid in full). I called MS on November 29th to get my points banked (Feb UY) and again on December 1st. Points finally showed as banked on December 2nd, three days after purchase. I'm certain of the dates because I emailed my guide on 12/1 voicing my displeasure (understanding it was out of his hands but feeling the need to vent).

My points were banked by MS when I called them the day after I gave our credit card. I saw on my dashboard that they went into 2022UY.

Our guide told me to call MS and I did.

Which just shows never wait until the last day with DVC for anything. If I had a Feb UY and wanted to buy, I’d call and pay today!
 
Just a word of caution--I emailed this very question about 2021 points being added to a 2022 direct purchase to a DVC guide today and was told that 2021 points are only added to 2022 purchases made 4 months before the desired UY. So if you will be purchasing a June UY, 2021 points won't be added for any purchase after Jan 31.

I was asking about a Sept UY. Here's the reply:

"Yes, purchasing points in the previous four months of the desired UY will not receive 2021 points.

A Sept UY will need to be purchased prior to April 30th to be able to bank into Sept 2022-2023. Any purchase after April 30th will not receive 2021 points."

Not sure if the replies from other members above depended upon a distinction for an exemption granted later by a call to Member Services (versus written into the original contract by a DVC guide), or if there was a different timing exemption for 2020/2021 points due to Covid)

But regardless of how DVD obtained the points (ROFR, buy-back, foreclosure), once they sell it to you it is considered a direct sale though, right? Or are you saying a lender other than Disney foreclosed?
I bought them through foreclosure, not direct. When Disney forecloses they go to public auction.

This is what they will try to tell you but they can’t legally sell you a contract without 2021 points if you are in your 2021 UY.

Now, they do not have to allow a new owner to bank them when past the banking deadline. But, that ability is currently written in the home resort rules and regulations that allows them to do it.

Obviously they try to push new buyers away from buying late in a UY and if it is a sold out resort, they have let people walk away if it is close.

But, if someone wants to add RIV and says I want to buy 200 points today with a March UY and I want them banked, or I don’t buy, they will find a way to make it happen.

You need a new Guide. I’ve done this multiple times with less than a week before my next UY starting and never had any issues with getting the points banked. I call MS the following day, and the points banked without a problem.

I had assumed Disney would take possession like a REO property, since there’s no real estate agent needed and unlike a typical bank foreclosure where the last thing the bank wants is the property back, Disney has ample resources to seek the points.

Disney will only get back the ones where there is a loan and the amount left owing is greater than the fair market value. All foreclosed contracts go to public auction (whether for dues or loan) and Disney can credit bid up to the judgment amount (so they do). They don't bid above that though so if that amount is less than FMV it will be a 3rd party who will end up buying it.

I tried that with 180 points at RIV as a new member and they wouldn’t budge back in Sept, they wouldn’t sell me a Oct or Dec UY. Tried two different guides and no luck, went to their managers and said there were no points to sell.
 
I will say a Disney Member Services person filled what I thought was a stripped resale contract with 2020 and 2021 points and late banked them for me without even asking me.
Weirdest and most joyous experience of my life.

It has to do with Disney not being able to put into an email the banking exceptions. When I bought my Aulani points a few months ago I had emailed my guide about “double points”, he called me to let me know that they could do it, just can’t email about it.
 
I tried that with 180 points at RIV as a new member and they wouldn’t budge back in Sept, they wouldn’t sell me a Oct or Dec UY. Tried two different guides and no luck, went to their managers and said there were no points to sell.

I forgot about this. Over the past 18 months when they made exceptions for owners who would lose points due to the closure, DVD actually gave owners points from RIV to replace the expiring points.

Normally, this would not happen, but now that you mention, it did because they had given many of those to current owners and didn’t have those 2020 points in stock anymore which is what they would have needed at the time.

But, under normal circumstances, purchasing late in a UY is no issue with a new resort, and sometimes even sold out ones as evidenced by the current poster who just got Feb UY points for OKW yesterday.

That's exactly how it went. Points were loaded and banked.
Congratulations!! The 30 day window makes it much easier to make these decisions. I think disney has the 30 day grace because they know most of us end up keeping the points 🤣. Once they appear in your account you start to plan more trips.
