OK so a week ago today I made an offer on a resale contract and the seller accepted on the spot. Paperwork was e-mailed to us Tuesday morning. I faxed mine back right away with our deposit. It was kind of a pain b/c my husband was out of town and we both needed witnesses but b/w the 2 of us we worked to get it done. But the seller still hasn't signed the paperwork!!! Ugh! I believe he/she/they have until tomorrow to get it done. If they don't do it in time, then what??? Guess I get my deposit back and go back to square one. I am so frustrated, especially given the 3/20 changes. Thanks for letting me vent. Maybe it just wasn't meant to be.

So long as your contract states that the seller must execute by 3/15...if they do not, then you do have the right to back out, and get your full deposit back. You also have the option of waiting (if say the broker can assure you the documents are in process).

I feel your pain, I am in the same boat, except I guess I am hanging on 'til the 17th (Fidelity told me this was pretty much their deadline to submit to Disney by 3/20.)

OP - We did just as you did, and sellers took the full 7 days! Anyone hear about fax machines, scanners and e-mail?????? My sellers waited for snail mail to get the contracts and since they had to sign within 7 days I guess they found a fax??? Good luck, be patient in the big picture this is very small!

I don't know why the back out - and any other time it wouldn't be quite so bad but I'd like to see it sold before the deadline. I did hear a little bit ago that the 3rd buyer still intends on purchasing so hopefully tomorrow we'll have the signed paperwork. DH keeps saying that the third time's the charm.

Happy News! I just rec'd an e-mail that the sellers have returned the contract and it has gone to Disney for ROFR! Now for the next "wait". In all seriousness, I am grateful that we have this opportunity and whatever the outcome (I hope this doesn't sound too weird) I enjoy the resale process!

The contract we are selling went to ROFR 3 weeks ago today but it feels like its been months since I have heard anything! Our purchase just went to ROFR on Friday 3/11 so we are only a few days ahead of you!!!!! We can wait together!
