Preliminary Hearing was Today-Just Not Sure About Our Justice System

For those that are following the story of my friend and her baby who was violently shaken by the babysitter, the preliminary hearing was today. Of course, the bond was very low and the babysitter has bailed out and is at home now! Only a $15,000 bond is ridiculous. I understand that there is no prior record and she is not considered a flight risk, but really, where is the justice?? The babysitter sat in jail for 5 days. Hannah has been in the hospital for 11 days and has another surgery scheduled for tomorrow. On top of all that, this babysitter has the "biggest, baddest" attorney in our town on her side. I never liked the man anyway and now he just makes me SICK!! The babysitter confessed to shaking Hannah, but pled not guilty today. I understand there are legal ways around all this, but I am just disgusted with our "justice" system today. Please pray for Hannah as tomorrow is the day they insert the permanent shunt. Again, thank you for listening to my rantings.

I can't get poor little Hannah off my mind. Sending many good thoughts her way for a successful surgery, and a good recovery.

It is so hard to see Lori on television and watch her heartbreak play out for everyone in the area. I am so angry about all this and to watch that woman go home when Hannah is still in the hospital just makes my blood boil.

Don't give up on the justice system though! Hopefully, till all is said and done, she'll be held accountable. IF that doesn't happen, remember, in the end, God is the final judge and we all pay the piper at that time.

Actually, the justice comes during the verdict and sentencing. I can understand your frustration, but if she is not a flight risk and does not have a prior record...then she should be allowed to post bond and be free until she is tried and found guilty. It is one of our most basic rights and while it seems unfair because of the awful things you know she did, it really does benefit us all that the court system does not persecute someone by keeping them jailed before the evidence is presented, if they are not a flight risk.

I wouldn't worry, she will get justice in the end. It just takes time.

poohandwendy, I understand all you said. I think what is bothering me the most is the attorney she has. He is RUTHLESS and I so worrry about what he will be able to do with this case. The newsreporter described what had happened to Hannah and I just don't understand how anyone could accept this case. I know it's all about the money for him, but still...

Someone would have had to taken the case, she has to have a lawyer. It's a shame that she didn't wind up with the worst lawyer in town, but still, someone has to do it. If this guy (the lawyer) is truely a bad person, he will get what he deserves in the long run. I'm a huge believer in karma!

Shaken Baby Syndrome is exceedingly hard to prove. Many doctors are starting to believe that this syndrome no longer exists. There are websites dedicated to SBS defense as well.

Prayers for Hannah, but with a good attorney, I do not think you will get a conviction.

(There were many articles about this in the Chicago Tribune magazine section in June of 2005. Very interesting reading.)

I know there is so much I don't understand about the legal system and yes, I know someone had to represent her. This isn't a public defender he CHOSE to take the case. I guess what is bothering me is that she confessed to shaking Hannah and said what she actually did: grabbed her around the chest and shook. Yet, yesterday she pleads NOT GUILTY!! The two charges are aggravated assault and aggravated battery. I don't know enough to understand what it all means, but I do know it will be horrible for this baby and her parents if this woman gets off lightly. You're right in that the ultimate justice lies with God, but we want to SEE her pay for what she has done.
