Photos Prints Bought at Park. Copyright Release forms?

I am befuddled as to why it is so hard to get a copyright release form for the picture (8X10) I bought in the MK (WDW) recently. Anyone have any thoughts on this subject?

Because, obviously, Disney wants you to purchase expensive prints from them and not Wal*Mart.

What are you trying to do.. have Walmart copy the picture?

Because if so - they won't and Disney won't issue you a release unless you bought a Photopass.

At least that's my understanding.

I think, perhaps, you meant to say "....bought all of your Photopass pictures on a PhotoPass CD."

Yep the same reason if you have a local photographer take your picture, and buy a picture from them. There wont be a release for that one either. It may be you in the picture, and you bought the picture, but that's it. It's like buying a DVD or CD or any other copyrighted item. You cant make copies of it

I am trying to understand the descrepency in the fact that I can get the right to copy any picture I buy online. But any picture I have printed in the park I don't???? That makes no legal sense and seems contrary. Why would I ever buy a printed picture in the park? How can the cruise lines photo releases be so easy but these are so hard.

Yes it is easy to say it is the Disney greed but I choose to believe it is just a policy that hasn't been thought out/through.

And yes I just want to make christmas cards from my picture.

You only get the release if you buy the CD (which is either $99 or $124 depending on when you buy it).

If you have disney print the photo (either in the parks or online) you don't get the release. Disney wants to at least get the $99 out of you.

Then either buy the number of copies you need from WDW, make them yourself with a scanner and printer (although this still is wrong) or get the CD if it was cheaper.. Those are really the only 3 options I can think of, and one of those options isnt 'right'.

Really no descrepency, it's just the way it is.

None of the pictures I have bought online ever came with a release. I think the CM was getting the CD confused with all online purchases.

You get a release if you purchase the CD online, but I don't think you get one when you purchase a print online. The releases are a .jpg file on the disk.

Well I have but I haven't contacted the Disney Legal team yet. By posting it here it also makes people aware that something as simple as copying a picture for postcards is not possible with photo prints from Disney parks which might cut down sales of prints if someone doesn't get on the stick.

I doubt it, as most people I would assume do this as more of a family memory shot then with the idea of making 30 copies of it to use as a xmas card...

The photos aren't taken by Disney...they contract it out to a seperate company. Since the PhotoPass system is owned and operated by Disney, they can do whatever they want...including not giving you legal permission to copy and print photos.

Additionally (if it's the same as it was 2 years ago and I'm remembering correctly), the photo release from DCL is only good for 30 days.

Each Disney Theme Park and the DCL are run seperatly from each other. Each park has their own rules and ways they do things.

When you buy the Photo Pass CD, there is a waiver of copyright both on the outside of the CD case and when you insert the disc, it gives you the option to print the waiver. The Photopass Photocenters told me this. Why would they give you copyright for one photo? It doesn't serve their purpose. It is a pretty good deal to be honest to get the CD if you have enough (or at least enough good) photos taken. Compare $12.95 for a 5 x 7 to about $1.50 at Wal Mart... Simple math. Sorry you didn't realize that before, I do sympathise with your frustration, but they are pretty clear about it there.

We have 116 original photos and by buying the CD, I can add great borders and autographs to the photos that they took and then have those added to the originals on the CD when they make it/mail it to me. Great deal.
