Pelosi, two other Democrats failed to disclose roles in family charities

WASHINGTON — U.S. House Speaker Nancy Pelosi and two other prominent Democrats have failed to disclose they are officers of family charities, in violation of a law requiring members of Congress to report non-profit leadership roles.

Rep. Rahm Emanuel of Illinois, the fourth-ranking House Democrat, and Sen. Evan Bayh of Indiana also did not report they serve as family foundation directors, according to financial disclosure reports examined by USA TODAY.

All three foundations are funded and controlled by the lawmakers and their spouses, and do not solicit donations from outside sources.

Pelosi spokesman Brendan Daly said Friday the speaker will amend her reports. He said it "was an oversight" that she had not listed her position dating back to 1992.

Members of Congress and top executive branch officials are required to file yearly reports on their personal finances, including any positions they hold with businesses or non-profits. At least 16 other lawmakers from both parties have reported holding similar positions, records show.

Bayh spokeswoman Meghan Keck said it was "simply an oversight" that he did not disclose his charity role. Bayh has since amended his reports, Keck said.

Emanuel, chairman of the House Democratic Conference, does not believe the law requires him to disclose his foundation post, spokeswoman Kathleen Connery said. "We believe we're following the instructions of the (ethics) committee exactly right, but if we're not, we'll amend our report," she said.

Stanley Brand, a former House general counsel, said the 1978 federal ethics law does not allow lawmakers to omit their positions with family non-profits.

Pelosi and other Democrats made ethics and greater transparency of how they do business a top priority in the 2006 elections. When the Democratic-controlled Congress convened Jan. 4, the House changed its ethics rules but did not specifically address financial disclosure forms.

The Senate passed an ethics bill this month that would boost penalties for knowingly filing false financial disclosure statements.

"Despite all the ethics reforms, there's still no enforcement," said Melanie Sloan, a former federal prosecutor and head of the liberal-leaning Citizens for Ethics and Responsibility in Washington.

Filing a false report could be prosecuted as a felony, Sloan and Brand said, but prosecutions are rare. Last year, then-Senate majority leader Bill Frist failed to report his role in a family charity. He updated his disclosure form and wasn't punished.

Democrats put own money into charitable foundations

WASHINGTON — Rep. Rahm Emanuel made millions as an investment banker. Sen. Evan Bayh had leftover cash after two successful campaigns for Indiana governor. House Speaker Nancy Pelosi's husband, Paul, became wealthy investing in real estate and technology firms.

It was with this money that each of these Democrats started a charitable foundation.

Emanuel, Bayh and Nancy Pelosi are officers of the foundations that carry their names but failed to disclose the fact on their annual financial disclosure reports filed with Congress. Tax records show the foundations donated mostly to hometown charities that reflect the lawmakers' personal and political attitudes. None of the foundations received donations from outside sources.

The oldest and most prominent of the three is the Paul and Nancy Pelosi Charitable Foundation. Created in 1992, the non-profit has donated hundreds of thousands of dollars in recent years. The charity reported having about $576,000 on hand at the end of 2005 after donating $316,000 to other charities that year.

Georgetown University, Paul Pelosi's alma mater, was the biggest recipient of the foundation's giving. Georgetown received nearly $300,000 since 2003, including $10,000 to the university's Wall Street Alliance, a group that raises the university's profile in the financial community. Vincent Wolfington, a Georgetown classmate and business partner of Paul Pelosi, was vice chairman of the alliance at the time of the donation.

The San Francisco Museum of Modern Art received more than $80,000 from the Pelosi foundation in recent years. Roselyne Swig, a longtime friend and financial backer of the House speaker, is on the museum's board of directors. The congresswoman has represented a part of San Francisco since 1987.

The Rahm Emanuel and Amy Rule Charitable Trust was formed in 2002, when the Chicago lawmaker was first elected. The former Clinton White House aide and his wife, Amy Rule, are its only donors. Emanuel was an investment banker after serving in the White House.

The trust reported having $2,900 on hand at the end of 2005 after receiving $34,000 from Emanuel and donating more than $31,000.

During the past three years, Emanuel's charity gave nearly $25,000 to the Anshe Emet synagogue and school in Chicago, and $15,000 to the foundation run by former president Bill Clinton. It also gave $14,000 to Marwen, a Chicago charity that provides art classes and other educational help to low-income children. Rule is on Marwen's board.

The Evan and Susan Bayh Foundation, also formed in 2002, reported having $663,000 in assets at the end of 2005. It gave $55,000 in 2004 and 2005 to a charity that provides direct financial assistance to Indiana National Guard members and their families.

Nearly all of the foundation's funding came from money left over from Bayh's gubernatorial campaigns. Bayh served two terms as Indiana governor, leaving office in 1997. State law allows candidates to transfer campaign funds to charities.

Bayh doesn't plan to raise any more money for the foundation, said Meghan Keck, his spokeswoman.

Of course it does. Anytime see she's anything that has to do with bashing Pelosi or other democrats it matters to here.
And gee, isn't it shocking that these people actually denoted some of the money they made to charities instead of buying a ranch in Wyoming or Texas?
 
I'm a Republican and I'm more than willing to jump all over (figuratively ;) ) Pelosi over something she's done, but c'mon, there's gotta be something better than this? :rotfl: :rotfl:

Seriously, this has got to stop. I don't care which side is doing it, I don't care who started it but this petty stuff, namecalling and mudslinging has outlived itself. How are we ever going to get anyone intelligent to run for office if this is the kind of garbage they are going to have to put up with?

A substantial ethics violation is one thing and anyone who gets caught with their hands in the cookie jar should get slapped. This doesn't pass the smell test.
