In the POtC Chess game recently pictured---what stage is the game in?

It has come to the Parks Game Semantics Police's attention that the game is not, as is widely rumored, in stalemate. A closer look at the board reveals that it is, in fact, at a stage where either white or black could move, regardless of which skeleton is playing which color.

Now where did I put that picture that proved that? :confused:
