I believe initially that the OP son was also picked up by the police but not charged. Since it isn't a real gun and the charges filed were assault and not assault with a deadly weapon I belive the OP son wouldbe safe from prosecution.

What I meant was, not that the OP's son could be prosecuted, but could the OP, or her homeowner's insurance, be sued because of an injury to a child on her property? Not saying this will happen, but could it be possible?

There *was* no injury - kind of the whole point of why in the heck did this mom go to the police.

And for those interested - Dustin went up to Scott in school yesterday and was "so incredibly sorry" his Mom is doing this, and he is "so mad at her" because of it, and thinks she is "crazy"

Hmph - I think Dustin's got it right, after all.... BAD kid or not!

Just to clarify I'm not trying to compare this situation to drunk driving. My point is that moments of stupidity do not go unpunished.

I understand. And I think you and I are actually in agreement here.

Moments of stupidity should not go unpunished BUT the punishment should fit the crime and, if I'm not mistaken, we both agree that in this case it did NOT. Being arrested was too much.

Cathryn, I hope you are doing okay. Some people were a little harsh. I know you're tough though. I would like to hear how things turn out for Scott. If the charges get thrown out or whatever.

Sorry, I meant to imply perceived injury as opposed to actual injury. You know, if his mom is po'd or "crazy" enough to go to the extreme of having a kid arrested even though there's no injury, what else would she do? Glad to hear that at least Dustin is forgiving, maybe this will be one of those 'beginning of a lifelong friendship' moments. Ya know , "Hey remember when you shot me and my mom had you arrested?!?"

If there was NO injury (not even a mark), the mom needs to get a grip and back off.

No, I don't like the idea of them running around shooting each other either, but I also don't think it's that big of a deal. (I also don't like kids popping each other with rubber bands, but I sure wouldn't have them arrested over it.)

I would imagine that she'd better get rid of her son's "gun", because the next time he "shoots" somebody this may come back to haunt her.

Also, I wonder if a lot of this is because the mom thinks her kid is always in trouble because he's "picked on" (can't tell you how many times I've heard this since I work in the school system - the child isn't at fault, he's just being picked on by the teacher, other kids, etc.), and she saw this as an incident that "proved she was right" (and I don't think she was).

I think the women definitely over reacted. As far as the airgun thing it doesn't sound any worse then paintball guns.
