ONe more question about annual dues via a resale

I was reading that if you purchase points on the current year, you are responsible for the annual dues. However, if there are only 45 points left on 2010 out of say 100, are you still responsible for annual dues?

I am going to assume it depends on the seller and what they have paid.

For resale, all of the fees, including the dues, are fully negotiable. Dues are based on calendar year, not use year. Personally, depending upon the use year, I'd propose that the seller pay all 2010 dues if there are only 45 current points left.

It just depends upon how anxious the owner is to sell the contract.

This is definitely an area that can be negotiable with the seller. When we sold a small contract last year, it only had 8 points left on its 2009 UY. I chose to pay all of the 2009 MF's since I used most of the points. Plus, we were not closing on the contract until August, leaving me as owner for most of the year.

I just passed ROFR on a contract that had all allotted points for this year available, but the seller was motivated and agreed to pay the fees, anyway. So, as the others mention above, those dues are quite negotiable.

I am currently buying a resale through Jaki and **** and there were 79 points left for this UY from a 120 point contract. We prorated that and i will end up paying $170 of this years dues because the points were comprised. The UY is April so the dues had not been paid yet. If you buy a contract and the UY for this year had passed then the dues should be paid in full already.

Just a clarification. Annual dues are by calendar year, and are due January 15th, regardless of the contract's UY.

So, at this point, everyone's 2010 dues should be paid in full, unless they have set up monthly payments via auto debit from a checking account via Disney.

We have a June UY, and I paid my 2010 dues in January. The only time this would be different is if someone buys a new contract mid year from Disney...then the dues are paid on a pro-rated basis from the time they purchase.

It depends, how many 2009 points are available for use before October 1, 2010?

If most or all of the points are available, and will become your points after the rtransaction is completed, then I think you should probably pay at least a portion of the dues.

Remember, when your new point arrive on Octobe 1, 2010, then the previous owner has already pre-paid 2 months dues on those points.

I suggest looking at the issue from the current owner's point of view. He is thinking that he has already paid dues for 2010 since those fees are due in January each year regardless of UY. Further, he won't get to use any of the points for 2010. So, to his way of thinking (if I read your narrative correctly), you are also asking him to pay next year's dues. While I don't feel any calm and rational negotiation is unreasonable, were I offering that contract, then I wouldn't be amenable to paying dues for a contract I no longer own come January, either. I might be willing to split some costs if I really wanted to rid myself of said contract, however.

Yes, in a resale, if you are paying the 2010 dues, those will need to be paid at closing. When we bought our one contract last year through resale, we paid the 2009 fees and had to add them to the check. I don't think Disney allows the sale to go through unless the current dues are paid, either by the prior owner or the new one.

Well, we specifically asked about the 2010 dues when we purchased last week (cash sale) and were told that we would not be paying any MF until January 15, 2011. I suppose I need to call our guide about this. I'll report back with what she has to say on the matter. Thanks for the heads-up.

Yes, please do as it would be great for you if they don't require you to pay any 2010 dues! Those can also be tracked on the member website and it will show whether there are any MF's due or not. Good luck!!!!

I wrote to our guide and she called me back right away. You are correct; we will be billed prorated MF for 2010 immediately after closing. When she said the MF was paid already, she was referring to the 2009 points that we received as an incentive, not the 2010 points. Thanks for the info; I wouldn't want to be unprepared for the upcoming $ requirements!

OMG! We were looking at that same contract. We went with the 150 pt contract though, and are now waiting........ Anyway, we were told that if the current year's points are "compromised" if you offer to pay half of the amt of dues left, usually, rofr and seller will accept your offer.

I am glad that you have the correct info. I know how it is when you are planning for things, especially with money, and then find out you need it sooner than you expected!!!

Congratulations! You will love BLT. We have stayed twice and I love the resort. We waited for this to be built and can't wait to go back in August (doing a split stay between BCV studio and BLT 1 bedroom).
