Not that we haven't suspected this....(A thread open to interpretation)

Sorry, but I do feel the need to clear this up: as steamboatpete said, a trademark gives you very specific rights. It prevents another person from attempting to confuse your customers by providing the same goods and services as you under the same name. It simply isn't applicable here. Where there is no potential for confusion, there is no trademark infringement.

Even if the trademark for 'Yavin' could be extended to prevent the use of the name 'Yavn' as an individual's pseudonym (which is doubtful to say the least), the point is moot because there is not current trademark on the name. There was at one point (it was held by 20th Century Fox, not Lucas), but it was canceled in 1986. It covered toys, specifically and exclusively: "Play set showing environment of aspects of plant life, containing toy figures, buildings, vehicles, etc." If the trademark were still active, and if VMK were to attempt to release a 'Planet Yavn' playset, then the trademark holders might have a case. Otherwise, under current trademark law, there's no problem.

Lucas (or rather, Lucasfilms, Ltd) does, however, own at least one current, live trademark on the name 'Skywalker', as well as a few for Shmi, Anakin, and Luke Skywalker, the Skywalker Ranch, and Skywalker Sound.

At any rate, like I said, if it was company policy to pass avatars around, or if Yavn's avatar was a role account rather than his personal one, he wouldn't have all but disappeared for so long; his successor would have just taken over. If VMK was in the habit of allowing different people to operate the same avatars, no staff members would ever disappear - instead of all this concern and hoopla over Hula's reduced hours, they would have handed her avatar over to someone else to run a few games a week. And, as I said before, Yavn is someone who VMK is very interested in doing business with. He's a big deal in gaming, and they're not going to do anything that's going to upset him. And, given that VMK is very much his baby - anyone who read his blog before most of it was removed knows how he felt about the game - and that he's still in the Disney 'family', I think it's more than likely that he's still involved on some level and has been around at least once or twice since the summer to touch base or consult.

lucas is pretty leniant with parody's (e.g. i am your father comments) but like you said merchendise etc. he is tough. ( i liaten to the force-cast)

You may be a state copyright attorney somewhere, but the fact of the matter is not that the name Yavn is a username on a MMPORG, but the fact that the name is used in promotion of said website. It is not obscure, but blatant, with Yavn even admitting that he took the name from Star Wars. If he was just a player, yes, there is no leg to stand on, but since he is the producer, using the name in various newsletters, bulletins and other posts, yes, it is covered. ... But the fact of the matter remains that "Yavin" is Trademarked. Go buy some Hasbro Star Wars toys and you will see the little TM up there. Skywalker, however is not. But I for one would love to see you try and use "Tatoonie" or "Dagobah" in a movie book or MMPORG (as a title, not a username) and see what Lucas does when he finds out. He is one of the absolute worst (or best?) when it comes to protecting his trademarks, copyrights and other intellectual property. ... If you would liek to discuss this further, please send me a PM, I am sure we could go back and forth on this for months, even years. My father was a property rights lawyer (including intellectual) before he retired and I worked in his office as a Paralegal for 5 years. Since his retirement 15 years ago, he has been teaching property rights law at a University here in Rhode Island.

The isn't really any such beast as a state copyright attorney. Copyright and trademark are primarily matters of federal law. Lawyers from state to state follow the same federal and international laws.

I'd be very surprised to learn that "Yavin" was trademarked, since I have never once seen a product based upon Yavin, but if it was, I'd bet a month's pay that the trademark was not sought for the purpose of marketing computer games or similar items, so our Yavn is on safe ground there. In trademark law, first in time/use does not necessarily control, and I would bet that if Lucas tried to stop Yavn's use of the name, he'd fail. In fact, if Lucas tried to capitalize on Yavn's VMK notoriety by marketing Yavn stuff, he could get shut down by Yavn or Disney, and the fact that he created "Yavin" first would not matter.

Could I use Tatooine or Dagobah? Sure, under many different circumstances. If I wanted to make a rock band called the Tatooine Sandmen, Lucas probably couldn't do a thing to stop me. If I wanted to sell toys based upon a desert planet I called Tatooine, I'd probably need to license the right or be prepared to expunge all my profits and pay some damages to boot.

You could make a lot of interesting law school hypotheticals by posing questions about Lucasfilm's (or whoever owns the rights) Star Wars IP, but I don't feel the need to take a long debate into PMs. If you still think that someone can copyright a name, title or short phrase, however, ask your dad what he thinks. Any good IP lawyer knows that you cannot, and I'm sure he will tell you the same. We can't go back and forth for years anymore than we could go back and forth for years arguing about whether water is wet.

Lucas is lenient with parodies because we have a constitutional right to make parodies even against the wishes of the copyright holder for the original work. He can't do a thing about it. That parody song "Yoda", for example, infringed on neither Lucas's IP rights nor the Kinks' IP rights (for the original song "Lola").

By the way what is the going rate for a tooth these days? Fortunately I haven't lost a tooth in about 25 years and back then it was $2 if you were lucky. I am sure kids these days are finding the keys to a new car under their pillow.

And that is about all of the Lucas in our family have in common last name only too bad the cash flow does not continue within the same last name :thumbsup2

Oh and my first last name is after a very rich basketball player. So there again height can not be passed on either.

Sad our names can not be trade marked or copy righted that would make it illegal for me to sign any documents. The end result would not make me liable for anything.
