NJ Drivers under 21

I'm not saying it wasn't his fault - I'm saying it was an accident and it didn't deserve a ticket. Also the other car was going faster than it should have been and she obviously wasn't paying attention or should would have been able to slow down. She hit him in the rear tire so if she had seen him (which she stated to DH that she "looked up and he was there") she would have missed him. She was the mother of another student in band with DS and she was heading up to the school to pick up her son. She was late and I'm sure she was going faster than she should have been.

DS is going to reimburse us for all of the auto costs (ours and hers). I just don't think it's fair to pile a ticket on top of it. I have been hit by a car pulling out of a stop sign and the other driver didn't get a ticket.

All accidents are a result of some form of negligence (short of an act of God). They are accidents in that they weren't done on purpose but they were also the result of some action or failure of action. In your example it was misjudging the safeness of proceeding forward along with misjudging the speed of the other car. While not done on purpose they were both the result of some sort of negligence and were ticketed as such.

In almost every accident scenario there is someone who can be ticketed for something even if it is only failure to control your vehicle.

I'd actually be much more concerned with THAT than why my (your) son did get a ticket. Is there more efficient enforcement? Is the city in a budget crunch and simply overall issuing more tickets - legitimately - to increase revenues? Are young drivers subject to different laws than experienced drivers? Did the person who hit you have some type of 'connections'?
