I fell down the stairs at Liberty Tree Tavern. The CM downstairs looked up and saw me falling (it was quite a spectacle). No CM ever asked me if I was ok (my ankle ended up swelling to an enormous size) or even approached me to confirm I was ok (My son had to help me walk back to our table). Never thought it was sue worthy.

We were at the Liberty Tree in August. I had our waitress pour hot water from a teapot down my arm. I was so embarrassed by the incident I wanted to hide. My arm was red and sore but it did not blister. We were on the dining plan with 8 people in my party, and we were still required to pay the 18% gratuity. I wasn't thinking clearly I just wanted to get out of there. Normally I would have refused to pay 18% to a server that burnt me. Maybe it's the restaurants management that figures look the other way and the problem will go away. It worked in my case.
 

It's more like CMs have been instructed not to touch, or talk to anyone they see fall to limit liability.

The company I work for had someone slip on a wet floor in our lobby (it was snowing outside) she fell in the middle of 4 wet floor signs, sued, and won her case.

With the teapot incident, the server was probably just embarrassed.

So what happens when there is an injury (due to a fall) I can't imagine that the person would be left there yowling in pain. That seems like it would be a liability as well.
