I live in North Carolina and currently work full time. My boss just came to me and told me she needed to cut my hours from approx 35- 40 hours a week to 13 hours a week to give her deadbeat son some hours. I cannot stay on with so little hours. Will I be able to file for unemployment? She wants me to finish out this week and help "train" her son. What do I do?

Start looking for another job pronto. When the deadbeat son stops working, she's going to lean on you to pick up the slack again. Then, when he wants to work again...

I hate bosses like your boss.

I think we can apply for unemployment based on your reduced hours, but I trust someone with more experience there chimes in.
 
In our state you cannot collect unemployment for "under employment" some states it is allowed. I would look on your state unemployment site and see what the rules are for where you live. If they totally let you go for this reason you WOULD be able to collect in most, if not all, states since your dismissal had nothing to do with you.
 
Sorry about the situation. I've found working for small family owned buisnesses to be very risky. One thing I wouldn't do is train her son. I'd rather just walk from the 13 hour a weeks and make her deal with her new employee. I know that may not be an option, but if it is, walk. Hope you find something soon.
 

personally, i would walk, and there's no way in you-know-where i'd train that woman's son to do my job. on my way out the door, i'd tell her what i thought of her for taking my hours, and if she wanted to take my job away from me and give it to someone she knows won't work, she could train him herself. i've walked away from a job before in similar circumstances, and wouldn't hesitate to do it again. life is too short. i hope, whatever you do, that things work out for the best for you, OP :hug:
 
Thanks everyone. She knows very well that 13 hours won't cut it, I think this is her way of not letting me collect unemployement. Trying to get out of it. Sneaky.
 
No good can come of this. Any mistakes or problems that said son has will be blamed on you and your training of him. It's just wrong.

I already told her I won't be back, I just feel it is wrong I have more respect for myself than that.
 
I don't know, tricky situation. Not that I blame you for walking, but if you do you likely won't be able to collect. You'd have to take the reduced hours and then collect (if your state allows you do) for under employment, or wait for her to lay you off completely and then collect. You'd have to check your states rules, but I'm willing to bet if you quit just because she cuts your hours, you won't be able to collect.

I'd force her to lay me off and only quit if I had another job lined up, but that's just me.
 
Think if your full-time and work under 24 hours you can collect unemployment in NC!
 
This happened to me. I was working 32 hours a week and when the store merged with another, I was cut to 8 hours a week. I went to the unemployment office and was able to collect partial unemployment for one year.

An HR person in CT once told me that if the employer moves too far away from their current location, cuts your hours, or cuts your pay that you can frequently collect if you quit for these reasons. I don't know how accurate this info is, but it seems like it is at least worth a call to your state's labor or unemployment department. Good luck.

Is this a business they own? If not I would check with the owners or HR and see what the rules of nepotism are. Some companies don't allow it.
 
I don't know if this is the case in North Carolina but in Rhode Island to collect unemployment you need to prove you had good cause for separating from the employer. I quit because my paychecks started bouncing and the state deemed that good cause and I was allowed to collect. Of course it took me 3 months and the threat of lawyers to win the case but I still got the payments.

This isn't the answer you want, but I believe it's the truth:

She wants to give your job to her son.
She doesn't want to pay your unemployment.
She thinks that by cutting your hours, you will leave voluntarily; this means you will not be eligible for unemployment.

There's more than one way to get rid of an employee, and your boss has chosen a back-handed, dishonest method.

If I were in your shoes, I'd start looking for a job IMMEDIATELY. However, I wouldn't quit the current job. 13 hours a week is better than 0 hours a week, and it'll allow you plenty of free time to search for something else. I suspect that deadbeat-boy will be a disappointment to his boss-mom, and she'll offer you more hours again . . . but do you want them? Look. Look now. And good luck.
 
Thanks everyone for your advice. The more I think about it the more I feel she is a dirty dog.

Heard back from unemployment office. I cannot collect because I left. I could have collected for under hours if I stayed, but under the circumstances not possible.

Great news though. I have a job interview next Weds. They seem VERY interested and the hours are wonderful. No weekends. :banana:

i'm sorry you can't collect unemployment, but, IMHO, you absolutely did the right thing under the circumstances. there are just some times you flat-out have to stand up for yourself, and this was one of those times (IMHO).
