Actually, that may not be true. I remember another case with Jet tickets, and Paypal refunded, based on the auction saying next day delivery. If she paid by CC with Paypal, she'll also get her money back.

In any case, I can't see why the buyer should be punished..since they can't take it up with the delivery service. Only the person who shipped can.

As I said earlier, if the OP wants to take the chance of a neg, and her chances with PP and eBay, she can see what they do..or even small claims court if the buyer wanted to. As a future buyer I would look very closely at that neg before buying. As a seller, I would refund and do as another said..take it up with the delivery service, since it's really their fault (if the OP shipped at the correct time to be sure of overnight) and only the seller can deal with that. That's just the kind of cusomer service I would offer. I wouldn't wait to see if I could get away with not refunding.

But it's really up to the OP..what does she feel is fair?

PS by how much was the package delayed, if you shipped on Thursday, and the game was on Sunday? They would have had both Friday and Saturday to deliver, wouldn't they?

The seller shipped the way she stated she would in the auction and the item was delivered (or will be) ..most likely any complaint will be denied. I was wondering the same thing. The OP did say an NFL game, so I'm assuming it was played on Sunday. Unless the OP shipped on Thursday and missed the deadline time for overnight, so then overnight would have meant due to arrive on Saturday.

It's a sticky situation and I think you have to refund, but you do have to wonder why the buyer didn't try to contact DHL if he had the tracking # and knew the seller was out of town? Even though it definitely IS the seller's responsibility, if I were a buyer and knew this information, I would have been on the phone to DHL. Of course he wouldn't know he could pick up at the tracking station or whatever, but wouldn't you still at least call?
 
That is my point. Dont you think if you were anxious to go to this game after paying money like that you would be trying to find out what is going on? I know I would especially if I knew the seller was out of town. I would have been calling DHL the next day when the package didnt get to me. I still think the buyer had some responsibility in this because they did bid on something that was only a few days away taking the chance they would get the tickets in time. The seller did what they said they would and shipped overnight.

I really dont think paypal will rule for a buyer in this case..now a credit card chargeback probably because they usually do those things mostly for customer service sake but as a buyer I wouldnt do that if I knew it was going to affect the seller. But that is just me. I take responsibility for myself and dont try to play a victim - this buyer knew the time constraints and still bid and allowed the tickets to be sent overnight knowing that sometimes overnight doesnt make it overnight.
 
I agree the buyer is not at fault. He should have called DHL and was trying to tell me the tracking code was not valid, however now he admits it is correct.

I shipped in plenty of time. DHL admits it is there mistake. The package was delayed at the sorting facility. So that ends any disputs of is it the sellers fault for not getting it in in time or the buyers fault for an invalid address. It was 100% DHL's fault. They will refund shipping only. They say NFL tickets are on their prohibited list and the package was not damaged.

I am refunding the buyer the entire amount. It sucks as he was fully aware of when he was purchasing, i was out of town, etc but its not his fault either. I just got ripped off a few months ago and just can't do it to someone else.

I really didn't care about the negative feedback. Its more of taking the high road and not ripping off someone else. I am a firm believer in what goes around comes around so I have to refund.

I will try and get my fees back from ebay though. Thanks for that tip!
 

jeepgirl: I give you alot of credit for totally refunding. I wouldnt have. You did what you said you would. I really think 1/2 would have been fair as it was neither of your faults
 
On the bright side, it's not going to be $125 dollars but you MAY be able to sell the unmarked/unused tickets to a collector on EBAY or a fan of the team. Try to list them and see what happens, atleast it will be something.
