Magic Access Fastpass?

Do regular Fastpasses have to be available to get these? I'm thinking of buying for a 2 day trip plus a little. The flight would get in at about 3:30 and by the time I would get to the park, I doubt Fastpass would be available.

If FP is done for the day, you can't get them. It's possible Iron Man FP will still be available but not necessary given the wait time. Once the school year starts, wait times should plummet and Hyperspace Mountain wait times should return to 15 minutes or less in the evenings.
