Looking to sell, can we split the points?

I have a friend that is interested in our DVC points, but they would like to split the points with a sibling. Is that possible? Also, how do I go about selling to an individual without an agent or can I do that?
 
Individuals cannot split contracts to sell. You can only sell what you originally bought. If you bought one 160 points contract, that is what you may sell. If you bought one 100 point contract and an add-on of 60 points, you may sell the two separately.

If the siblings want to share the contract, you could sell them your contract and they could title it with some type of joint ownership. That may not be a good idea because sharing DVC points will require a lot of cooperation and trust. Just because people are siblings doesn't mean they can get along well enough to share. But that is up to them.

You do not need to go through an agent to sell. Some others here are better at explaining that process than I am.

All an agent does is find a buying and some hand holding. In this situation it's pretty simple to change it over but you still must go through ROFR and since it's a sale, DVC can take it at the same price family or not. And it's illegal in FL and all states I know of to put one price when it's really another. What you can do that may help some is buyer pays closing then basically do the closing yourself for a lot less or use a company that is much cheaper like LTransfers.

If you move forward with a private sale of any type, here is the basic process.

  • Contact DVC by email and have them email you the info packet to get you started. This should give you instructions and Transfer form #1.
  • Once you have that completed, just return to DVC as instructed along with a formal contract. That contract has to include the specifics including legal descriptions, points status, who pays fees, buyers, sellers, price, who pays closing and the like.
  • At that point DVC will either buy it or send you a waiver of ROFR along with a second transfer form. Then you'll need a deed and record that along with the ROFR and complete a tax related form with recording costs.
  • Once recorded, just send a copy of the recorded deed along with transfer form #2 to DVC and in a few weeks you should be all set.
Costs if you do it yourself maybe $50. The cheapest company I know of is LT Transfers at $125 plus postage and recording so maybe $175. A full service broker might be $450. Title insurance is not reasonable in this situation.
 
i have sold an okw contract myself, back in the day. but i would use a broker today. they handle everything, i just sign the documents and wait.
