Liability when renting points?

We may want to rent some points, but I was wondering about our liability. For instance, if the renters trash the unit, are they responsible or are we as the owners of the points?
 
You as owners. You can assign liability by contract but it is on you to enforce. Disney will enforce on you; your collection from renter is via legal remedy that does not remove your liability to Disney.
 
You also have liability if the renters don’t pay all their room charges. That is less likely now since disney now posts charges every night. You also could be on the hook if the renter asks for an upgrade and the front desk uses more of your points for the villa change.

We have always rented our points out thru a broker. All this was covered in their contract. I always felt better having the broker to help recover the funds from the renter if anything went wrong.
 
I only rent(give) my points to friends and family. If I wanted to rent out my points to the general public, I would go through a reputable broker. I haven't used the site sponsor, but I'm sure they are a good choice.
 

Ultimately you but in all my years here it's maybe been posted about 1-2 times? Maybe? And another couple of times for charges and at least one if not both of those were family members staying in the room. It's rare enough that I don't consider odds high enough to be concerning.

While I'm not claiming it has never happened, I have literally never heard of a single case of point renters trashing a unit and point owners having to pay. I have rented my points many times and it has always been to a family with kids or a couple. People just don't go to WDW with the intention of having drunken rowdy parties in Disney hotels. A group of 12 people all with different last names wanting to rent a Grand Villa during spring break might give me pause for thought, but that has never happened and I doubt it ever will. Groups of college kids wanting to have a good time will tend to go to cheap AirBnBs, as opposed to pay the huge premium prices for Disney hotels.

As for the renter asking for an upgrade, just be sure to check the box saying "Not a DVC member" against the renter's name when making the reservation. This tells Disney that the renter is not the points owner and should preclude the renter from using more of your points.

If a renter asked for an upgrade and the front desk processed it on your account, the points would be taken from you, Once the renter checks in, it is belongs to them.

Its one thing I think should be in the contract that they can not do this.

Wow, that's wild. Agreed, that would make a ton of sense to have included to avoid any issues with points. Begs the question if they upgrade and the cost is more points would it take away points from bank for the following use year?

Probably not and I think most times, the front desk refers the guest to call MS now..which a renter can’t do.

It may be because they aren’t well versed and have messed up accounts for owners when doing so.

But renters don’t always understand the true difference between cash and rental so I think sometimes the ask comes because many cash guests do.

What has happened often is that even just changing a room the front desk uses new points and the existing on the reservation go into holding. Usually they let MS know who corrects but if there's ever a change done when you're there it's good to double check your account. The front desk could borrow if they wanted to.
