Looks like we may have found a resale......thanks to you all, i feel like we are making a pretty educated purchase, however i have one more question:

If we are purchasing a June use year with all of the points for 02 and 85 from last year, does it seem appropriate that we would pay the 2002 maintenance fees? Seems to make sense, just double checking......

Yes, since you will have full use of the 2002 points the maintenance fees should be your responsibility.

Expect the seller to ask for maintenance fees for the 85 banked points also. If they don't ask you'll be ahead of the game.
 
Obviously, everything with a resale is negotiable.

If you got the price down so far that Right of first refusal may be an issue, its better to raise the per point price and lower other things, like dues, and closing.

I think that the place to start is paying dues for any points you will have use of.
 
You need to look at the overall package you are buying, but by the time you are closed, you will really have about 3 months left in the dues-year. You will pay dues again in January for all of thecontract points. Dues are NOT really for your use year, but are based on the calendar year. Disney prorates the dues. If this was a direct purchase , you'd pay dues based on the date of your deposit until Dec 31.

Since you are getting the use of 85 points from '01 and all of the '02 points, I would consider paying the maintenance fees if the purchase cost is right. If you are paying top dollar for the contract, full dues and closing costs, I'd sure think twice.

Just remember that everything is negotiable in these resales.

Like the above posts say, everything is negotiable, we have purchased 2 resales and I will say that it is typical for you to pay the seller the maintenance fees for 2002 in your situation, then you will also turn around in January 2003 and pay maintenance fees for that year. Your maintenance fees will always be due per calendar year, not according to your use year. Beginning in Jan 2003, you have the option of paying your yearly maintenance fees upfront or you may spread them out monthly by automatic debit from your checking acct. You will be notified by DVC towards the end of this year inquiring about how they should bill your fees in January.
