Well Jodi, if the lens had a zoom on it and can't indicate whether or not you were kneeling taking the photo of his bottom half sitting, how can you say it was taken accidentally? You don't use zoom accidentally.

It's a death penalty case. Judge has to allow some leniency so that on appeal, JA can't say she didn't get a fair trial and wasn't allowed to tell her story.
