Is this illegal?

My sister in law is fixin to start a new job as a teller making $7 an hour, until she finds herself another job. The thing is minimum wage is $7.25. The owners of this bank have been infamous for their cheapness for all of their life and the owner is practically knocking on death's door now. But isn't this illegal? They employ more than 6 people I would think. Help

There are several exepmtions to the FLSA but I can't imagine what one a bank teller would fall into but if I was your sister I would ask her supervisor what exemption they believe she falls into to pay less than minimum wage. If they don't have an answer and change her rate of pay I would save paychecks and once she finds something else file a wage claim with the Federal DOL (I'm assuming she is in GA like you) as GA has very lax division of labor.

If she filed a claim before leaving it would be illegal for them to retaliate against her but any employer could easily claim economy or something close which is why I recommeded waiting until she had a new job as I believe she has a two year statue of limitations.
