I know, I just mentioned it so that any NY residents who saw your post and thought since there wasn't a warehouse in their state that they wouldn't have to pay tax, would know they actually would have to

I thought we did but I didn't see it on your list.
I know in the past I was never charged tax by Amazon (luved it!) but unfortunately I now am so I thought maybe there was a warehouse around.

Ok, so basically I should get DBF one with more then 8 gigs right? He basically just wants to use it for 1 or 2 movies, we have music on our phones but not movie capability. I'm sure he will add some music but I don't know how important that is to him.

if he is not a big techie and you do not want to spend almost $300 on a gift then check out the 16 gig 2nd generation refurb at the Apple Store for $199 but I would also suggest dropping a few extra dollars on faster shipping, because as I stated before it took a full 10 days to receive one for us, not sure if that is the norm but just to be careful.

only new york has the internet goods taxable even if business is out of state law. Amazon actually got rid of several "individual sellers" who were situated in new your because of the hassell of the taxes, i don't know if they ever let them back in i just know my friend was banned from selling because he lived in NY so he started using his parents NC address for all his business w/ amazon bacause of the new york law.

the 32 gig and the 64 gig have updated hardware and software

Does anyone know, if you buy one at Target, the midprice one (is that 32?) is it the newer generation? I am so clueless, but my mom got one for each of my kids this week for Christmas at Target, the midprice one, so I guess it's 32?

Yes, if she bought them at Target they will be the newest generation.
