In your opinion...what does "No Overnight Parking" mean?

I think you need to check with your City ordinaces ... call the city offices.

Some of these companies that get the towing contracts can be quite aggressive ... I think you need to find out how the official ordinance reads before making a decision to fight it.

Absolutely. I would bet that the tow truck was parked within sight of the sign and ready to go once the time passed 12:00. They should post the times. "Overnight" is too vague.
 
I can't believe people are still talking about this. Teach your son that if it is not clear whether parking is allowed, don't park there. Like some other posters, I'd be irritated with my child for getting my car impounded. (Happy he figured out what to do, but still thinking he shouldn't have parked there.)

I honestly can't believe all this "fight it - the sign wasn't clear" stuff.

Arguing that he wasn't there "all night" only when he was caught is just silly IMO.

With this argument, there's no such thing as ticketing for overnight parking because if they were caught before the night ended they didn't stay overnight. Yet, if you caught them in the morning how do you prove what time they came? I'm guessing people would expect video surveilance tapes proving their presence "all" night?

Not to mention all the people that still think there was a city ordinance or a ticket involved...the vehicle was towed from a private parking lot, as the OP came back and clearly told us, oh, somewhere a few pages back..:) There's nothing left to fight....he already paid the towing charges.

"Overnight"
If I come to your house at midnight and stay for 1 or 2 hours, I am not there "overnight." I am there "during the night." If I come to your house "during the night" and stay until morning, I am there overnight.

Our Walmart has a sign for "no overnight parking" and it is open 24 hours. Figure that out and it will be clear why that towing company (or the sign) was clearly wrong.

We're not "fighting" anything. It's funny, we have a few connections to the city and state police, and DS was laughing yesterday that "If it was a TICKET, I was all set to start yelling off the names of every police officer I know!" :laughing: I told him that wouldn't do him any good, although he COULD have gone to court under different circumstances. It's not a crisis, and fair or not (because I think as a common courtesy the sigh SHOULD be clearer), it is what it is. :confused3 Not a huge deal in the whole scheme of things.

But I think it's highly amusing how long this thread is! When I started it, I wondered if anyone would have anything to say. :rotfl2:

I lived in Providence and you had to have a driveway or pay to park your car in a lot.

Actually no, I think we'd still be having the same debate.

Some of us would say if they found your RV there in the middle of night with you asleep and no shopping involved, you would be breaking the intent of "no overnight parking." Others would say you could sleep there, but wake up before daylight and, as long as you hadn't spent the ENTIRE night, you would be fine.

Well, I suppose I should defer to your expertise, with you having lived in Providence, but I find it hard to believe that there is NO overnight on street parking ANYWHERE in Providence. Providence isn't just downtown...there are smaller communities all over the place.

And if overnight is "usually" after 6 PM to 6 AM, then it really needs to be clearer. DS's law teacher thought it was 2 AM - 6 AM. But I've been to events in Providence, and there are cars parked all over the place. :confused3 I can't imagine that all the streets of Providence are supposed to be clear after 6 PM at night. :confused3

lets not forget Providence is broke and is trying to rack up any kind of income they can. I am sure they have tow operators just lurking for the clock to strike 12 so they can tow cars. I got a ticket for parking on the side of the street while going to the hairdresser. The sign was on the other side of the street, there were no signs on the side I parked when I came out, 25.00 ticket. Providence is bad with ticketing.... they lurk around the hospitals, courts, and downtown all the time looking for expired meters etc... Another one they are famous for is the 2 hr parking, they don't put the signs all the way down the street so it looks like your safe but nope, they ticket you. My husband works at the state house. In the winter they don't plow the employee lot good enough and there is no parking ( there is no parking on a good day, with people working at the mall parking there). So the employees were forced to park along the street.. guess what, they towed about 100 employee's cars for parking over the 2 hr limit where there were no signs.... Have to love Providence.....
 
Another one they are famous for is the 2 hr parking, they don't put the signs all the way down the street so it looks like your safe but nope, they ticket you.

I would never assume that if there is no sign, it would be safe. The rule here is that if there is a sigh saying it's not safe to park, or an arrow pointing in the direction of where it's not safe, people have to assume it is not safe until they see a new sign that does say that zone officially ends, and lists the new rules. We've had to walk all the way to the end of the block to read the only parking signs. So we know it's for the whole block, not the first 25 ft or whatever.


Our problem here in NYC is that there are often 3-4 signs posted. One has to learn, (usually by being ticketed first,) that the most inclusive sign that takes in all the other signs are the rules. You can't just pick any ONE sign that you think applies when there are 3-4 posted.

I *think* the rules are that there is No Standing during 7am - 6pm, Mon - Fri. Commercial vehicles with commercial licenses plates are allowed to park, no standing, for 3 hours between 7am - 6pm. They have to pay the meter, or they will be considered standing.

Everyone else can't park there until 6pm. But, it's metered parking till midnight. with a 6 hr limit. So someone can park there at 6pm and pay until midnight. (Then it's free after midnight. But the car must be moved by 7am.)

Sat, anyone can park and pay, 8am - midnight. But, only for 6 hours max. After midnight, it's free parking for all until 7am, Monday.
