I think my son will be too small...

I don't understand why buying a new pair of running shoes (they always seem tall in them for a few weeks) as opposed to wearing the flat flip flops is cheating the system. There has to be a margin of error on the safety engineers end for variances of shoes. If you are within 1/2" and buy the right shoes...I say use your judgement. One 3 yr old 40" and one 39 1/2" makes for a challenging theme park vacation! Disney is an art, not a science.

I didn't say that it was. I am saying that there are people who go out and look for stacked heel shoes or boots or clogs with a thick heel to deliberately get over the height requirement.Which if someone does it fine, as long as they understand that if something were to happen they would also have to share in the blame.I go to disney often.I have heard moms and dads belittle and berate the ride Cms because such and such ride will ruin their kids trip if they can't go on etc. I think kids learn to deal with things alot better than we as adults give them credit for.Even if they do have a melt down, I doubt that one little disappointment is going to be a life changing event for them.I will agree with those that say disney needs to be more consistent with their measuring techniques.But at the end of the day... it is what it is, and don't get to worked up about it.Disney will always be there.
 
Something to also consider, Disney's 40 inch mark is not the same at every ride. I don't care what anyone says, our DD measured 40.5 inches before one of our trips barefoot at the doctor's office and they would not let her on Soarin'. She did go on test track though.:confused3

i agree we had issues too.This is the only complaint about height restrictions I have.Inconsistency. If they say no, I just let it go.I saw a woman go nuts on Rockin roller Coaster,She was screaming and trying to shove the Cm, dropping the F word ever y30 secs .....Why? because 2x her child was able to ride during their trip and than that day, he measured too small and they would not let him ride.It was awful to see because the little boykept saying" its ok Mommy lets just go"..i felt for the poor kid.
 

When we went down in 2005 my DS was just about that age and while he did make the 40 inch mark, big brother made the 44 inch mark so will still had to kill sometime. He loved Buzz Light year, Tommorowland Transit Authority, POTC, HM, Tiki Room.
I do have to agree with the others that have said be prepared for inconsistancy especially if he is just at 40 inches. We did have a couple of times where it was very close to him not making it on some of the rides even though he had ridden them before luckily the CM made a judgement call and let him on because he was that close. Also be prepared to be measured multiple times in a line, we ran into this several times on Splash Mountain.

As for the shoe sole thickness, most theme parks/amusement parks allow for a certain thickness for the sole of the shoe. If you think about the ride manufacturer would be stupid to deterimine the hight restriction on the ride based of a person being barefooted, because obviously everyone who rides the ride is going to have some type of shoe on and the thickness of the sole/heel of that shoe is going to vary. So when they determined the hight restriction they did it with an allowance for a certain amount of hight provided by a shoe. I know that parks owned by Cedar Fair allow for 1 1/2 inches. Now the rides at the water parks obviously are going to be based on a person being barefoot, since the expectation would be that people at a waterpark are going to be barefooted.
 
Why is it that the small kids are always the daring ones? My DS was tall enough last time, but he didn't want to do the big kid coasters (he didn't even want to do Goofy's barnstormer!). :confused3
