I SO wish I had just bought through Disney

Our closing date (per our contract) was today. I have not received any e-mails in quite awhile from TTS or the closing company, so I called today to see if everything was final and closing had gone through.

Nope! The seller still has not returned their documents. We received notice on July 11, 2008 that we passed ROFR. We sent our closing documents and money order for the closing costs on July 14, 2008.

I REALLY wish now that we had just went through Disney. The AKL incentives are really enticing----and now that the seller WON'T send back the documents, I am really wanting to just forget the whole thing.

And I'm really glad that somebody notified me.:mad:
 
Why isn't the closing company pushing the seller. She is in breach of contract at this point. Talk to a manager and demand they contact the seller. This is ridiculous to be sitting waiting so long with no correspondence. I have however found that I must keep following up when I have/had a contract pending. I especially feel you should have been notified considering TTS is the sponsor of this forum.
 
If your contract says closing is today....call you broker and tell him it's now or you walk and want your money back.

I am pretty sure that in real estate if the other party doesn't come to the table as scheduled they have breached the contract and bets are off.

TTS seems to want to "wash thier hands" once they send it to closing, but they don't get paid UNTIL closing so they need to keep on top of things IMHO!
 
I'm sorry things aren't coming together for you! If you do decide to walk away and buy through Disney, I can tell you it is a breeze! Seriously, one phone call, deposit made with a credit card, the documents arrive FedEx within days, you sign them, have a notary sign them, bingo, you're done! It is sooooooo easy! Actually, a little too easy! Especially when spur of the moment you decide to add-on!:rotfl:

Wow....Thanks for the heads up, I just contacted TTS today but just may scratch that and go with Disney, this would be my 3rd contract and I was a lil scared to do someone other than Disney, please keep us posted,
 
I'm sure they'll come through, maybe they were out of town or sick or something. Remember, the seller won't get paid until they send in their paperwork and the deal closes. It's in their best interest to get their paperwork in.

Going through resale does take a little longer. We just closed today on our second contract. It has been about 12 days since I sent in my contract and $$. I hope your deal gets closed soon, but I wouldn't worry too much yet.:goodvibes
 
Yup, the same thing happened to us. The seller draaaaggggeeeeddddd their feet big time. But at least they made it with closing signatures on the day the contract was due. It's a pain in the butt waiting. :( Especially after you shell out the big bucks!!!!
 
I passed ROFR on 6/13.. they have had my $$ since 7/6.. still no closing, no info.. nothing.. I am beyond over this.. the settlement date on my contract is 7/28.. still NOTHING!!:headache: :mad: I went through GMAC.. I know I should have listened..:sad2:
 
I had a similiar problem last year. We passed ROFR, I sent everything in right away and we were just waiting for the seller. I was in constant contact with Jamie at TTS and they just could not get ahold of the seller. The bottom line was that she told me I could wait a little long (if I wanted to) or cancel. I ended up canceling and starting the process over since there was a very similiar contract available. That one went through as smooth as can be. Recently I called TTS to purchase a small add on. I asked Jamie and would you believe they never heard from the guy selling the first contract. It was just like he fell off of the face of the earth. Unfortunately they can'y make the sellers get the contracts back in a timely fashion, but if it does go past your scheduled closing date you can cancel and get a full refund or if there is another contract available they will hold your funds pending closing.
 
Wow! This is all news to me. I thought folks here loved TTS! Sorry you are having a problem. I just recently looked into GMAC also but my dh is more comfortable going through Disney. I was going to launch a campaign to convince him otherwise but I think I'll wait a bit...

I went through GMAC and everything went very smoothly. I think it all boils down to who the seller is with either company. That said, I'll probably go throuhh Disney now that I'm in the system.

Yes it really is not the resale company holding things up.. It is just very frustrating..
 
You have to wonder why people drag their feet. Do they have seconds thoughts or are they just too lazy.
 
Wow, sorry to hear all you are having this problem. I have only bought through Disney, and everything goes smoothly, call our guide, and make an appointment to go in, but others have the documents mailed to them, very easy....just added on last Sunday, and have thought about buying resale in the future but now after hearing stories like this, I may just stick with purchasing through Disney, unless it is a resort, I love and can't get any other way....Good luck and please keep us posted!!
 
Hi, I am just sending my paper work back to Disney to buy and it was easy. I wouldn't go any other way, the incentives are great for AKV, I can't image a better deal through resale.
 
:confused: despite a clerical error on closing documents (which from working in the real estate field, know it happens more often than you'd think) that delayed our ability to be recognized in the DVC reservation system for an additional week, i was very happy with the services of TSS!:thumbsup2

We did pay for expedited closing (not sure if they still offer it) and it did speed things along after ROFR process.

What frustrated me was DVC took almost the whole allowable time on WL:confused3 ; cannot blame the TS agency for that;)

good luck to the OP, def. never hurts to call & verify that things are moving along in any real estate deal, especially a week or so before closing date (btw, real estate closings are delayed quite often, just one of those things if everything doesn't fall into place in a timely manner).

I think it's the seller, my Starwood ski week I bought a year ago went too smoothly. I was in the *wood system in 90 days.

I'm in the process of buying another timeshare and the seller took their sweet time getting the paper work in(in the seller's defense it was a unit they took over from another company, the agent handling it left a big mess when he quit rather suddenly).

If I ever do buy resale again DVC or not, I'm following Icydog's advice will call on a regular basis.

TTS is a very reputable company, but they can't force someone to send back the paperwork.

The resale broker does have some leverage with the seller. If you cancel (which you have every right to do), the seller technically owes the broker their commission even though the deal doesn't close.

Realistically, the broker will probably not ever see that money. They'll probably just de-list the property, refuse to have anything else to do with the seller, and move on.
 
I called the lady handling the closing today and told her that we want to cancel. She still did not have any paperwork from the seller. She said to call back TTS and let our broker know. He comes in at 11:00 today so is supposed to call us then. We are definitely canceling and going through Disney.
Yeah- it really makes me wonder what happened to the sellers. Did they change their mind? Are they just lazy? :confused3
