I just received the most unreal phone call

Background my mom used to live with us in our hometown. She moved out in rather uncertain circumstances in Dec. She moved to Las Vegas, we live 3.5 hours away. My mom knows some rather strange people.

My mom got subpeonad to report to court this morning back in our home town. She makes plans to come, Her friend has reported sex assault charges against a worker at her assisted living place. Moms friend is more then a little off and DMom doesn't want to come because her friend is most likely making the story up and she doesn't know what it is that she can actually testify to.

Fast forward to this morning. She calls me and says that case isn't for her DFriend it's for Chris!! Chris is my DHusband. My jaw drops and I totally panic. WHAT? The cell phone is garbled and she says yes they served him in person. I am so confused it is not registering other then I think this has to do with our finances?!? Yes he was served and it has to do with the waverunners! Huh? Oh my GOD. Thank GOD that is what it is.

Our waverunners were stolen a couple of years ago then recovered. My mom filed the police report. Last summer out of the blue we get a call saying they have found our waverunners. Just totally out of the blue, they had been gone for like a year and a half. We get them back, take one trip to the river where one floats away and the other breaks. It costs up 500 bucks to get the one out of hawk with the PD out at the river. I say sell these suckers. We sell them end of story.

To get this call from my mom saying she is at court and my DHusband better haul his butt down to the courthouse pronto comes as a unbelievable shock. No mention of a forthcoming case was made to me. No hey honey I was served today?!!? Nothing, NADA. I go up to tell DHusband that he has to be down to court asap and he says just says OH ****! I thought that was the 26th. No hey I forgot to tell you, nothing. Just mumbled explanations that I can't even hear.

I just don't even know what my reaction should be? If you keep something like this from me what else are you keeping from me? I mean this is one of lifes little details I would think you would share with a spouse. I don't think it is something my DHusband could of not appeared for since he was served in person. My DMom was served I guess because she filed the police report. I was not served so I had no idea that there was anything forthcoming or anything. This is all out of the blue.

Well, first I thought that said, "They served him in prison," so at least your troubles aren't as bad as I thought at first!

I don't know. Thats...why would he not tell you? Is there a strain in your marriage?

Wait - I'm confused. Your husband filed a sexual assault charge against someone in an assisted living home?

Ok, I reread it and it sounds better. Maybe he has a lot of stress at work and it just slipped his mind. It does seem like something he should tell you, but I wouldn't freak out about it until you can talk to him more.

And then you found out today that she was actually going to court about the waverunners? Wouldn't she have known what it was that she was going to court for? And if so, why did she also lie to you about it at first?
It all sounds very strange to me. I know you're upset, and rightfully so. But I feel like maybe I'm missing something here...

Yes he has to go to court, Yes it is about the waverunners. I am just dazed and confused as no mention of a subpeona was made to me by DH and this is the first I have been made aware that any legal proceedings were pending involving my DH were going on; I am sure it is just to state that yes he owned them, yes they were stolen etc etc. This all comes out of the blue to me and I am confused as to why my DH didn't mention anything about this before.

I guess I can't explain myself right... I don't think my mom led I think she didn't know what the subpeona was for. Maybe DH didn't know what it was for either and didn't put 2 and 2 together and realize his subpeona had to do with my moms.

i think I have it all worked out in my head but I will be talking to DH about why he didn't tell me he was served in the first place.

My mom just called and she was told she could go. Now I am waiting on a call from DH telling me wth is going on with him.

I am really confused by why your DH was served for wave runners that were yours but stolen, then recovered, then you sold. Are they saying you falsified the theft?

I'm guessing that since the OP didn't even know about the subpoena, she doesn't know what the case is about either. And since her DH is currently at the courthouse, she can't find out until she talks to him. Perhaps talks should be "talks." He's got some explaining to do!!!

After reading the original post several times, I have come to the following conclusion.

This has nothing to do with the waverunners unless somehow your Mom was related to the sale. If they were about the waverunners, I would assume you would have been subpoenaed, too.


Instead, if probably has to do with why your mom moved.

I would suggest actually talking to her and making her explain what is going on.

OP, It seems a likely explanation for why your DH didn't say anything to you is that he, like your mom, was subpoenaed to appear as a witness, not as defendant. So he wasn't too worried about it.

I'm guessing that somebody is on trial for stealing the waverunners, and that person is going to try to make it appear that there's doubt in the story of the people who reported the waverunners stolen (your mom and your DH). So they've been subpoenaed by the defense.

I think your mom was mistaken in saying "it is FOR Chris." He's not on trial. He'd have told you if he was on trial!

Anyway, that's my guess. Hugs for your worry.

My guess is that the reason for the police report was for insurance. If they were stolen and insurance paid a claim on the waverunners and you later got them back, then the waverunners should be the property of the insurance company.

So, chances are the subpeonae is related to insurance fraud. It sounds like a misunderstanding, but DH should have contacted an attorney long before this court date to find out what's going on, so that you don't have to serve him divorce papers in prison... Kidding - hope it works out...

Ok I got it figured out.
Nothing weird going on. It had to do with the recovery of our stolen waverunnerss, nothing to do with falsifying anything they were ours to sell once we regained possesion of them.

My mom was involved because she is the one that filed the police report.

My husband didn't tell me because he got served while I was not at home then got sidetracked with work (workaholice for real) the notice has been on our fridge this entire time.

I have some medical issues I guess you could say, I am legally blind and don't drive. No treatment for it and no pain.

They are all on the same page and have to appear again next Weds. I guess they just state that those are our waverunners that were stolen etc etc.

We did NOT have them insured in fact just dropped the policy a few months before as we had paid them off. Yes we filed the report hoping we could claim them on our homeoowners and then found out we couldn't. We never recieved a dime of money for them from any insurance company.

My mom showed up at court and they wanted to know if her "son" was with her. She said she doesn't have a son and it was all explained to her.

It's probably just finally the criminal case regarding the waverunners. Just because they got them back doesn't mean the case had been settled. It just took a long time to make it to court.
