I can't take anymore

I just got home from work late again. Yesterday my car battery died in my car, found out that I have 30 days to leave my home due to foreclosure.

Then today to top it all off, I get a letter from a debt collector that they are going to garnish my wages. I am sitting here crying and trying to breath and not give myself a heart attack because I am at my wit's end.

I can't handle anymore and the amount that they want to garnish is ridiculous, I have been paying them but now its not enough and they want it paid off. I can't even tell you the thoughts running through my head.

I feel so alone right now and there is where I come. I must be crazy, but now I just dont' know what to do or where to turn.

Try to hang in there, it WILL get better soon- things can't go downhill forever, even if it seems like that now.

Have you talked to any one about bankruptcy? It could be an option-if nothing else, if you start the paperwork it will stay all the debt collections (including your foreclosure) and give you some breathing room to get back on track.

Have you tried the credit boards? They have great ideas on stopping wages from being garnished, etc. Have they proved the debt is yours for starters?

Anyway, I don't know if it is any help to you, but a lot of people are rowing the same boat you are. You are not alone.

Do you have a clergyman or other strong person in your life to go to as a sounding board? (I am personally not religious, but have seen the help it gives to those who are believers.)

try and breath nicely. don't give your self a heartattack cause then you will be in the hospitol, and let me just say that i had a stresss anxiety attack that landed me in the ER, and it was freakishly expensive..anyhow i think there is help groups and organizations that you can contact...
 
So sorry you're going through this. :hug: Take a deep breath. Have you contacted an attorney regarding bankruptcy? That might be your best option. Do you have any family nearby? Trust me, there are many people in your position. I'm helping my best friend short sale her house right now. Bad things are happening to good people all over the country, but this isn't the worst. Try to re-group. It may sound silly, but making lists always helps me, and maybe you won't get so overwhelmed.

Call the agency that is trying to garnish your wages. Tell them you don't think the debt is yours. The best way to work with collection agencies is to talk to them.

If you're going that route, calling isn't best. Writing a letter about it and sending it with Return REceipt (so you can prove they got it) is the better way.


I was just reading a thread elsewhere and it was mentioned that companies cannot legally garnish more than a certain percentage of your income that isn't dedicated to needed things (housing, etc). So their little words don't mean a thing because they are limited legally to what they can actually do.
 
I know this may not be what you want to hear but maybe you need to somehow find a second source of income if at all possible to get you back on your feet

I have worked in Payroll and know that certain wage assignments (garnishments) can only come out as a percentage of disposable earnings, maybe 10%.

I am sorry you are going through this.
 
You should try to calm down and think this through. You might just have to declare bankrupcty. Have you contacted Consumer Credit Counseling? The foreclosure is scary but do go to the credit boards for advice to at least know where to start. Don't ignore these things but face them head on.
 
I, too, would be contacting a bankruptsy lawyer. There are ways to protect whats yours and stop these drastic measures.

It's not that I can't pay, I can and have been and I am willing to continue to pay, now they want more. Everytime when I called to make my payment they were nice as was I, now all of a sudden the tables turned and they are nasty and want more than double what I have been paying.

I was unemployed for over a year and made my payments, now that I am working again...I am making $500 less per month!! So now I can't even pay you more because I am making less.

I am not asking for a pass I owe them and I will pay them, but to not even work with me and go this far is what I just don't understand.

I am usually the person that is bubbly at work and tomorrow is going to be better but the past 3 days its has just been horrible and I truly felt like doing something drastic because I was so upset. I called an old friend of mine and he calmed me down and gave me some advice and told me they do this, but they can't take blood from a stone (never heard that one before). I had posted a thread earlier in the week in regards to this and now its worse.

I did not want to go the Bankructy route because its on your record for a long time 10 years I beleive and I don't want to do that. The Credit Card boards scared me a bit, so I didn't go on there.

Everyone has always been helpful and honest and that is why I come on here its my therapy. Alot of people don't understand that about this board. That is why I am here. I admit I overextended myself in regards to this credit card, but I am willing to pay the best that I can in this situation. It is just a shame that they are so horrible. God only knows how they are with people that don't pay anything.

Please take a few minutes and relax. I know things are stressful, but you really need to take care of your health at this point.

From my understanding and I also frequest CreditBoards quite often your wages cannot be garnished until after a judgement has been rendered against you in court (at least that is how it is in NC). Then the judge or mediator will determine the amount they can garnish. Please be aware that this notification usually means they intend to file against you in court, but you get your turn to show your financial situation. Be sure to review all of your mail as sometimes many people miss the court summons thinking it is junk mail.

Consulting with a bankruptcy attorney may be a good idea. Most will do the initial consultation for free. Obviously, you are not rolling in money so they may be willing to work out payments for their fees. Researching and learning how to protect yourself is your main priority at this time.

But please, don't let the creditboards scare you away. There are so many people in similar situations and even worse, plus many of them can really be extremely helpful.

Also, I think it takes a lot more than a letter to garnish your wages. That sounds like a threat to scare you into paying more. Sometimes creditors have all kinds of nasty tricks to get you to pay them.

Yes I remember you OP and I have to add this...first things first...I understand you don't want to go through bankruptcy due to how long on your credit report, ok, put that aside for the time being. The most important thing is to keep your home...How is it possible that you are being foreclosed on in 30 days? Have you contacted the mortgage holder at all? Have you been paying anything? I would call them & an attorney first thing tomorrow morning...even if you have to take tomorrow off from work.

As far as the credit card that you have been paying, they can try to demand more more more all they want but that is the least of your problems. Just continue to make the payments as you have been doing, they can't just threaten to garnish your wages, they (meaning the original creditor) would have to go to court & get a judgement to do that.

I empathize with your feeling of "I can't take it anymore" we have had more than our share of financial woes here too..and if we were to end up in the streets I would have to re-home 10 animals ( I kept saying the rescuer needs rescuing) so I DO understand...but bordering on hysteria (which I was doing too) won't solve anything.

You need to breathe, pray if you are a believer, or just do whatever you can to relax & re-group, meditate take a hot bath, have a cup of tea....start tomorrow off fresh with a plan and don't take anyones threats lying down or waving a white flag. You're stronger than that !

I know you don't want to go the Bankruptcy route, but if you're making $500.00 less a month that's a huge chunk of change. You may want to reconsider this alternative. No one who has a sense of ethics WANTS to declare bankruptcy, but in this economy it has become a necessary evil in order to survive.

Yes, a bankruptcy is on your credit report for at least 7 years, but be comforted in the fact that MANY people are declaring these days and it doesn't have the stigma it used to have. As an added bonus, bankruptcy will stall the foreclosure and perhaps make the bank become a little more dedicated to working with you to save your home. The last thing banks want is one more property they're going to have to maintain in a sluggish housing market.

Be aware that even though you're making payments, your credit record is already trashed. Many people I know found out that even if they worked with a counselling company to get their debts paid off, their credit record was just as bad as if they had declared bankruptcy. AND they couldn't get new credit without the same fees and penalties they'd get with a bankruptcy on their record.

ALL of them decided that if they were going to be dunned even as they were paying things off, they might as well clear all the debt and keep their cash. The system is set up to penalize them even if they did the right thing (as you've just found out).

I wish you nothing but the best of luck. I hope you'll reconsider bankruptcy and get some counselling about what your options are.
