How to add and remove names from DVC Deed?????

Hi there,

So in 2008 my parents bought into the Disney Vacation Club. At the time they wanted to put me as an owner as well, but because I lacked credit or something, they couldn't do it, but said that I could be added later, once the points were paid off.

Anyways flashforward now two years later. My mother passed away just over a year ago, and the points have been paid off. My dad would like to have my mother's name removed from the title for obvious reasons, and he would also like to add me as an owner.

We have no idea how to do this. We're in Canada so it's not like we can run to a Florida lawyer for help. Has anyone had experience with this? Any advise or directions? I would be so very grateful!

I am sorry for the loss of your Mother.

Since your Mother was on the deed, and has passed away, that may complicate the transition.

I would call a resale company (like the Timeshare Store) or a closing company to see if there is something special that needs to be done under FL law because of your Mother's passing.

Otherwise, you could obtain a Right of First Refusal waiver from Disney and file a quit-claim deed with the appropriate county. Assuming you own at a WDW resort, it would be Orange County, FL.

Could you please explain the quit-claim deed and how it works? My parents are up there in age and want to add me to the deed, but are afraid it could be really costly.

The US answer is your dad files for ROFR which is automatically tendered in this situation. Then you need a deed which is recorded in the county in question. For a single contract, this can be done for well under $50. TTT will do it for around $100 ($75 plus recording fees) but I suspect you'll still have to get the ROFR yourself. It's actually very easy. What I can't speak to is how the Canada location impacts the options.

Email me directly and I can send you a copy of a Word Quit Claim template specific for FL.

Have your father call Member Administration and they will be able to assist you both. This is what I did when my first husband passed away..

They can give some basic info but if they do it for you you're looking at $275 at least.
