Just got the mail and there was a letter in there from an attorney. Apparently, if we don't pay our delinquent taxes they are about to start foreclosure proceedings on our home. WTH? We just closed on this house 2 months ago and paid all our taxes for this year and next year at closing.

Well, come to look at the copy of the tax bill further and these are taxes from 2008--WHEN WE DIDN'T OWN THE HOUSE!!!

This didn't come up on our title search. It had a clean title. What now? This is not a small bill.
 
Get a hold of a good lawyer asap, preferably one who specializes in real estate.

What a curve ball!

A copy of that title search and clean title would do you well. I'd try to do as much of the leg work as possible prior to securing a real estate lawyer. It will make things go smoother and quicker. Also, contact the real estate agent that worked with you, find out if they have documentation that can help your case.

If you purchased an owner's title insurance policy when you closed on the purchase of the house, you have no worries. Just contact the title company/closing attorney and they should be able to help you.
 

I do have a copy of the clean title search in all the closing paperwork. Our real estate agent was a complete idiot who I would have dropped, but it would have made us end up losing the house. Once we closed, I reported her to the National Association for Realtors. I guarantee she would be of no help to me now.

I have no idea if we have an owner's title insurance policy. I let DH handle that part of the home sale. Would that be a full policy of its own or would it be in something?

Here's the kicker though: We have 10 days from the date of the letter to reply in writing to a PO box address. We received the letter today, and it was dated 10 days ago.

Are you sure it's legit? I've never heard of that quick of a turn around time. I'd turn it over to either the closing attorney or a real estate lawyer.
 
Sounds more like a scam and not legit at all. You should be able to bring the bill to the town clerk and they will be able to tell you what it going on.

If it is not real, whihc I suspect it isn't cuz the goverment would not have to write to a PO Box, then the twon wil now know about this company and maybe try to get them for fraud.

Your Realtor may be helpful, may not. Just the way some are. Either way, you'll need an attorney. You're not at fault in this. You don't want the legal process to move along, unchecked.
(And I would be keeping the letter AND the envelope.)
 
It’s legit. Along with the letter from the lawyer, came the copy of the tax bill. All the addresses are the same for when we protested our tax bill (we paid dramatically less than what our house was appraised at). It’s also the same attorney we received a letter from about our unpaid tax bill a few years ago—which, of course, was a clerical error on the county’s part (Thank God we had our receipt). The PO Box is because it is county, not town. We’re unincorporated here. The county is huge. It’s actually a PO Box at on of the court houses.
 
can you check online with your assessor to see if back taxes are actually in arrears? Or stop in the local office and ask.

I meant gather the documentation from the sale of the house and the clean title. It's not a lot of legwork. She can still get the real estate lawyer pronto.

OP, does the letter require that you pay within the 10 days or contact them within that time frame?
 
Local office is over an hour away, but, yup, we'll be going by/calling tomorrow when they open at 8 AM. We'll also have a letter out first thing in the AM and be calling the lawyers office first thing in the AM.

Turns out we do have title insurance; finally found the paperwork in a box (still not fully unpacked because we had a lot of work to do on the house before moving in). Woo Hoo!! I'm feeling quite a bit better right now. It might still be a long road ahead, but at least I don't feel like we're going to be caught holding the short end of the stick. Not that we couldn't pay it, but we shouldn't have to pay it. And it would have meant giving up something else, like Disney. :scared1: :rotfl: And all the stuff we need for the new baby (crib, clothes) that is on the way, since I gave everything way before moving and finding out about this little surprise.

This whole home buying experience has been a nightmare. Never, ever, EVER will I buy a foreclosure again. It was a fantastic deal, but it's been riddled with problem after problem. Darn good thing I love this house so much.

Even though I was 100% positive this was legit, I did what you said. It was good advice. It was on there. I have no clue to how this was missed in the title search.

Ours is all online. It will list the past years taxes due/paid...if they were paid.

Frankly, I wouldn't care if you did report your realtor. Call them and tell them what is going on. That's what you paid them for. If there is an issue with the sale, then they need to assist. Or your mortgage broker. Or the attorney they used.
 
We called first thing Friday morning and talked to the attorney’s office that sent the notice. She told me that it was a form letter and foreclosure proceedings will not be started right away; she didn't even know someone put that in the letter and she's the one that actually handles the whole thing.

She looked into our information and sees at some point in the past few months (she wouldn't tell us when), a huge tax payment was made, but somehow it was shorted. She also saw we didn't own the house at the time. Her big declaration was the title company somehow did shoddy work. She made the appropriate notes on our file. We did still send a letter, even though she said it was necessary. She also told us exactly what we needed to say to our title company regarding our title insurance. She also told us to go to the tax office (do not call or send a letter) and give them all the information. I'm way over simplifying this conversation, but it's the jist.

Anyhow, we went to the tax office and they made the appropriate notes to our file. Unfortunately, the person who originally handles the payments for the unpaid taxes (turns out it was the MUD taxes that weren't paid) doesn't work on Fridays. That whole darn office is closed on Fridays. So, we need to call and get them to make the appropriate notes on the file to this specific tax record; the other is just a general record. MUD taxes are handled differently for some reason. I never knew that since we write the check to the same person, even if we do receive two bills.

We called and left several messages for the person we need to talk to at the title company regarding our title insurance. We called every hour. We kept being told she was in meetings. We left several messages. Around lunch time, we reached her voicemail v. a live person, where we got an out-of-office for the day message. She may be blowing it off (earlier), or she may have been out-of-office for meetings. Either way is a possibility.

So anyhow, we just need to get on it first thing Monday. I'm hoping it is all going to work out easily enough though.

If you have an actual location & an actual person to talk to at the title company office, I would show up at that place with my DH first thing Monday morning. If your DH can't go with you, take a friend as a friendly witness. They won't be able to blow you off and delay answering your questions if you're standing there right in front of them.

I would contact the realitor and attorney who handled your closing.
