Here is a dumb HOA rule...

I really hadn't been paying attention to the story and then I heard it was the Stonebriar HOA. I was the one who drafted those documents in 1989! I've got copy of them in my desk drawer at work. I've got to look up what the heck I wrote back then. I'll find the exact language and post it tomorrow.

I do remember that the developers wanted Stonebriar to be ultra exclusive....back in 89 no one had heard of Frisco - I had to drive through cornfields to get up there. We spent months coming up with restrictions like no clotheslines, etc. I bet we DID put a no pick-ups rule in there.
 
Yeah, the rule is there and has been since Day 1 (Oct. 20, 1987)...Section 10.26 of the CC&Rs: "Any truck, bus, boat, boat trailer, motor home, campmobile, camper, motocycle, motorized bicycle, motorized go-cart, or commercial vehicle, if brought within the Development, shall be stored, placed or parked within the garage of the appropriate Owner so as to be completely hidden from view."
 

Interesting. According to the original rules they did not distinguish one truck from another but obviously since have seperated trucks from "fancy" trucks.
 
Right. So the homeowner's argument would be either waiver or selective enforcement.
 
Changing the subject for a minute. Since you do deed restrictions for HOA's in the Dallas area I was wondering if you are doing anything with Craig Ranch? We were in Dallas last weekend moving my daughter to UNT and I got to play the TPC course there. My buddy I played with was telling me about the restrictions on homes being built and they were unreal. Minimum 10,000 sq ft homes in one section on 1 1/2 acre to 2 acre lots. Your talkinf homes well over a million dollars and they seem to have had quite a few lots available. Seemed excessive even for us Texans.
 
No-wish I was! One of my (much better paid) partners just bought a home in a development like that. But price/size of home does not necessarily mean that someone will obey the CC&Rs. Years ago, John Travolta lost a very expensive battle with his HOA (and got to pay their attys fees) because he wanted to put a runway on his land.
 
I remember a picture of the 727? or some other big plane parked next to Travolta's house I saw. That was nuts. My friend told me that the lots at Craig Ranch were selling for $300k to $500k. That was just for the dirt! Build a minimum 10,000 sq ft house and supposedly your plans have to be approved by the Craig in Craig ranch personally.

And-of course-everyone's question is - Why didn't I buy land up there way back when???

I have a client whose grandpa bought a bunch of land that was mostly in a flood plain. Because of that, most couldn't be developed and they paid taxes on it for 40 some years. Then, the state wanted it for the George Bush tollway and $17,000,000 was deposited into the grandkid's trust funds!!!
 
I was on that road on Saturday. Going from Denton to Rockwall.

I ask myself the same question all the time. The amazing thing to me was that they took all the pretty land for the golf course along the creek and the area they are building houses in is a rather non spectacular piece of land without a single tree on it with a very slight roll of a hill.
