HELP PLEASE... State Tax lien?

Went in to buy a new vehicle yesterday. When they pulled our credit report it showed a state tax lien on it. I called both mortgage companies to verify they are indeed paying our taxes. They both paid them for 2009 and 2010 isn't due until the end of the year. We don't own a business or anything. WHAT could this be and how do I find out? I am disputing it on the credit reporting websites. But I have NO clue what it is. There is a docket number, but I called my municipal court and they only deal with traffic tickets. Who do I contact to find o ut what this could be?

I believe you are assuming it is real estate tax. Could it be a state income tax lien? Maybe your state amended your return and you owe them something. Try calling them. Good luck!
 
We live in Texas and we don't have state income taxes. Also, we have received NOTHING in the mail regarding this. We were shocked when it was on our report yesterday.:sad2:
 
Could it be someone else with the same name as you have? This happened to us. The lien should have put on another guy with the exact name as my husband. I was really surprised as our last name is not that common. It eventually got resolved and we had to sign something that said it belonged to the other person.

It could be that someone, somewhere has the same name(s) and has unpaid debts to someone and they attached a lien to your property. This happened to me recently and I didn't know it until we went to close on the property we were selling that had the lien! No problem, the other person's name may have been the same but the social security number, DOB, and other info was not the same as mine so our closing attorney took care of it. Makes me very mad though to know that any business can do this without verifying that they have the actual person. It could have cause us alot of problems!

is Texas the only place you have been? Could it be from another state. Did you google your docket number to see what kind of hits you got?
 
I googled the docket number and came up with nothing. We have been to many states. My husband is in the military. But, Texas is the only place we own any land. I have also not worked outside of Texas.
 
When you went to purchase your car, which credit bureau provided the report? I know you said you already have a dispute going with the credit bureau. You can call the bureau and request the information from them. They should have on file the name, address and phone number of the company that reported this to your credit.

:thumbsup2, and per the law if it can't be verified, IT has to be removed and you can sue for damages;)!( just wanted to add that since I just read another thread about people being lawsuit happy:rotfl:)


ps, but really, you can sue for damages as it is legit and will cause you $$$ and time in getting it taken care of and maybe deny you credit or at a higher rate due to no fault of your own.

PSS, at our local JAG office, you can actually get help with that, I would suggest you get there ASAP and they can assist you with getting the assistance you need or point you in the correct direction. ( the JAG office here does not play and the get things turned over to them rather quickly and efficiently and saves you time and $$
 
My guess is that you would need to talk to the clerk at the Bexar County Courthouse downtown (instead of the municipal court).

Is one of you self employed? Could this be sales tax?
 
Where did you live prior to Texas? Since you're military, if you moved, but didn't update that part properly, you may be still charged state income tax from PREVIOUS states you have lived (claimed as primary residence for at least 6 months out of any given calendar year.)

Military taxes can be VERY tricky. I'd look over your previous tax returns. That's a LOT of state income tax. Probably a couple years worth...the IRS may think you live somewhere other than you do.
 
Are the seller of the car, the financier of the car, and the insurance company willing to work around the lien as if it were not there?

If any of them are not willing to ignore the lien that you have sworn under the pains and penalties of perjury is bogus, then THEY and not the lien are the problem.

I would suppose that a simple (snail mail) letter to the entity named with the lien (state of Texas) should get a quick response identifying the lien in more detail.

A lien has to be against something. If you own real estate, you can go to the Registry of Deeds or Bureau of Conveyances or whatever that office is called and see if any liens are recorded against yours.
 
The lien could be misapplied. Regular scans are done of courthouse records by the credit bureaus and the computer system makes the determination as to where the lien belongs. You could call the credit bureau but they will only be able to tell you what name and address are listed for person the lien is against. The person you talk to will not be able to tell address or phone number for the reporting agency, at least not at Experian.

It's wise to dispute it. If it's not removed by all means call the credit bureau and explain the situation and see if they can dispute it with more detail.
