Help establishing values...

I'm bummed that I may have to pay my soon-to-be-ex spouse for my DVC points.

Can someone help with values (per point) for:

Old Key West (bought in 1997)
Boardwalk (bought in 2000)
Hilton Head (bought in 2003)
Saratoga Springs (bought in 2009)

Based on avg ROFR attempts over the past 6 months. I.E. What people have been reporting they are willing to pay for a resale contract.

NOTE: When you bought means nothing as all contracts at said resort expire at the same time.

Does your soon-to-be-ex-spouse have any interest in the DVC memberships? Is said spouse aware of the initial cost of the memberships or likely to do research to find out the current values?

If not, I would suggest reviewing the ROFR thread and choosing the lowest value for each resort you listed for a similar-sized contract. Price per point is very dependent on the size of the contract. Larger contracts tend to sell for less than small ones, since there is very high demand for the smaller contracts.

Even if you own smaller contracts, I would still suggest the lower end of the range and see if they challenge those values. It would not be fair to use the current list prices on the resale sites as a reference, since those are only list prices, and the contracts generally sell for less, with the exception of the </= 100 pointers.

Also, if your contracts are missing most or all of the current UY points, they would generally sell for less. If they have banked points, they would have a higher value. I am not sure what to say about the OKW points. If yours do not have the 2057 extension, those are almost always taken by ROFR for DVC to re-purpose them as 2057 contracts, and that may lower the value of those points as well.

I would stick with the general avg posted above. You don't want to over complicate or low ball her. Heck her lawyer may come back with the current direct purchase rates.

I not a lawyer, and I don't play one on TV. I also am not a real estate broker or appraiser and I have never been divorced and amazingly I don't have any close friends who have been through that process.

The reality is that this is a depreciating asset and there are a number of variables that affect the valuation of his individual contracts, particularly contract size presence and the current availability of points with his individual contracts.

OP probably should not post the details of his contracts, as it may make this look like an FSBO thread, but the reality is that his BWV is the only "hot commodity" on the list, unless, of course, his contracts are all 25-100 point contracts. The ROFR list is only a tiny snapshot of all of the transactions that have taken place over the past 6 months, but it is at least one reference point. Based on the 2014 ROFR thread, some seller was only able to get around $56 for their SSR contract and another seller only got around $55 for their OKW contract, so that may be the best that OP could get for this depreciating asset.

I suppose the spouse's attorney could reference the current DVC retail price of these contracts, but OP's attorney could probably easily argue that those would be unreasonable valuations by referencing current fair market values on the resale sites.

OP's attorney should probably provide some guidance in this matter, but I don't think there is anything wrong with starting on the low end. Who know, the soon-to-be-ex-spouse and her attorney may be surprised that a timeshare has a value anywhere near this level. If OP starts low, there at least is some wiggle room for negotiating up to the values that you have suggested, if needed.

Of course, if were only talking about a total of 200 points over the 4 contracts, +/- $5 per point is only a $2000 spread, so it may not really be that big of an issue in the grand scheme of the value of their entire estate.

If they want to use retail values, then let them. Tell her she can buy them. Then go buy them back resale with 1/2 the proceeds!

All contracts are for 100 or more points. The total exceeds 600. She never enjoyed them like I do and I want to be fair. There's enough BS for the lawyers to waste our $$$ on already. -David
