Has Anyone Ever Gotten Hurt

I was right there when John got hurt, sitting in the whirlpools watching. The CM tried to get me to do it, I refused and he tried to badger me into it. Even went so far as to make a snide remark. What I noticed was John having a difficult time getting out of the pool and the CM asking if he was ok. The CM quickly went on to the rest of the contest that included the second injury to the guy who dislocated his shoulder.

I've never been a advocate of the belly flop contest, or the beer drinking contest that occurs on other ships. It's terrible what happened to John and I hope that everything is okay. The CM went beyond looking for "volunteers" he was brow-beating guys to do it.

The scavenger hunt is where two groups of contestants have to run around the pool and deck area and retrieve different items that the CM's ask for....like anything with a DCL logo, a straw, a piece of fruit, a bathing suit piece, etc.

The contestants are encouraged to hurry back because they remove the chair (like musical chairs) of the last contestant back. I could see this being even more dangerous than the belly flop contest.

The number one cause of injuries around a pool is running, Aprilgail. The scavenger hunt makes me cringe because the contestants are expected to run to get back to the seats as fast as they can. AND they are encouraged to jump in the pool to get across faster -- one girl jumped so far she nearly hit her head on the opposite ladder! :eek: It's just not the kind of activity that should be encouraged around a pool. The scavenger hunts in Studio Sea, etc, are fun and fine, but add a little water to the mix... I should know -- I broke an ankle slipping on a puddle of water!
 

We were on the Magic, March 8th Eastern. I don't remember ever seeing the Belly Flop listed in the Navigator. Maybe they did stop it.....Let's hope. :-)
 
It would have been listed in the Navigator as Pool Games and would be held at the Quiet Cove Pool. It is usually held on sea days around 2:00 or 3:00 pm.

I actually just checked the 3/8 navs that Barb and Tony just posted....Pool Games was held at 2:30 pm on Thursday. I do not know if they changed the pool games at all since those people got hurt.

We are sailing on 5/17 and I will check it out.

I went to those pool games and belly flop was not one of them. It was more like relays in the pool. There wasn't any running around for scavenger stuff, either. :-)
 
I have read all the posts and I just couldn't shush any longer. I am so sorry anyone got hurt and I hope they have a speedy recovery. I also am prepared for anyone yelling at me, but ...

Aren't we all told from as soon as we can walk not to run around pools. These games are inherently dangerous. I feel, and I have a right to feel this way, that those who participate are willing to accept those dangers. Someone said they were brow beating people into doing it. I am the mother of 3 and this is the exact pressure from others that I am praying they can avoid when it comes to drugs and stuff in school. If we can't manage to deal with it, no wonder our kids can't. Disney wouldn't run these games if no one showed up and participated. To expect that Disney compensates for an injury as a result from something like this I think is a little much. (again--my opinion which I am allowed to have and I am truly sorry anyone got injured.) We have become a society where the minute something bad happens, we immediately look for someone to blame and pay.

And just so you don't think I don't have any background with this, I do. My then 4 year old got hurt in the playroom on our cruise a year ago. They had positioned rolling chairs as a barrier between the kids playing and the food they were setting up. My daughter decided to run and jump onto one and basically fell on her face. She knocked all her front teeth loose and damaged her gums. She looked awful. We took her to the medical center, they treated her and gave her antibiotics--all free of charge. When we got home, I had her checked out and there was no permanent damage. That was it, we didn't sue. I just don't believe in it. Accidents happen to the best of us. I did insist on talking to the head of the program to ensure that they get proper barriers and it didn't happen again. In today's society, I probably could have sued and won. If there was permanent damage, then I would have asked that I be reimbursed and nothing more. The main difference here is that the injuries couldn't have been foreseen. My daughter continued in the program on that cruise and we are going back in a year.

There have been other times in my life like a dog bite to the face that I still have a scar from that I could have sued and won, but stuff happens. Insurance took care of the bills and the dog lived a long and healthy life. No, it wasn't my fault and no the dog wasn't vicious.

Sorry for rambling and sorry if no one agrees. It would be nice if people used the courts to make changes to things. As part of the settlement, have them not do the games anymore.

If someone was injured on your property, you would be expected to compensate them for their injury and loss, why should Disney not be held to the same standards? It is unfortunate that your daughter was injured but she sustained no serious, permanant loss. I assume that she had an injury to her primary teeth, she has another set. To compare a severe neurological injury with potential traumatic brain injury and a C 6 fracture to loosened teeth is ridiculous. Disney should not be sponsoring a game that is inherently dangerous and continue to do so after an initial injury. If someone is injured then they need to step up to the plate not just send a get well card! :mad:
 
As I told the OP privately it really comes down to IF Disney had been put on notice that people were getting injured previously and continued the practice or not. If they did than she has a legitamate case, if not then her husband assumed the risk. In the example of your daughter, if they continued to use rolling chairs after a child just got hurt from them (there by putting them on notice ) they would be negligent. IF they continued it and another child was hurt seriously (ie: a brain contusion or such) they could not argue that they had no idea someone could get hurt. It all depends on whether or not they had prior notice.
 
You missed my point. When does the responsibility for our own decisions fall on ourselves? Why is it that no matter what we know inside and what we know is dangerous, we get hurt doing it and then expect someone else to pay? If someone falls on my property, then I will probably get sued--doesn't matter whether I was at fault or not. I will get sued. It is a very scarry thought that one day everything my husband and I have worked for could be just taken away like that. It is one of my biggest fears. I too live in CT, drive on I-95 everyday and see people driving around with their kids in their laps or without seat belts (those tickets alone could cover our deficit) and you know they are going to get hit one day and sue whoever hit them for major money when most of their injuries could have been avoided had they just taken the time to think and wear their seat belt.

My whole thing bringing this side of the discussion up was the concept of being responsible for your own decisions and actions and not who's injuries were bad enough to be compensated and who's weren't. I can't imagine anyone out there can say that running around a pool deck is a safe thing to do whether Disney says it is OK or not. Somewhere, people have to say no--I won't do it because it just isn't safe. I am also not saying you should never sue, but that some of the responsibility needs to fall on the individual's shoulder to just think.

Again, I am profoundly sorry anyone got seriously hurt. And yes, my daughter had no long term injuries. But to say it wasn't serious isn't correct. She could have damaged each and everyone of her permanent front teeth causing her to loose both sets. Also, any doctor will tell you the amount of bacteria in a persons mouth is very high and to have the amount of damage done to her gums that she did, she was open for any number of infections which is why they put her immediately on antibiotics. Any injury can be life threatening given the right circumstances.

However... do you truely feel that if your child had severe neurological damage that it would be ok if Disney knew it happended in the past and egnored it? I am not convinced that is the case in this situation, but to compare it to a serious injury if MY son was paralized or such from something they knew several people had been injured from before this would be the

I really think people do have to be responsible for their own decisions they do know they risks they are assuming if they are adults,, BUT if consistantly people are being injured-some severely than there IS a responsiblity on the part of the promoter to discontinue the event. I do not know for a fact that this is what happened I am only forming my opinion from the people who have spoken up.. I hope that in light of this the belly flop contest is rethought or at least is on a TRUELY volunteer basis then I say you assume the risk.

I don't feel as though skuba was either saying or implying this rather severe analogy. The following statement pretty much sums up the point being made -

Did I mention my husband is now a magistrate but used to actually practice law.. so I do know both sides of it,.,. he now tries to temper justice where before suing was what paid the student loans... I truely agree with all sides to a point,, it really truely comes down to if Disney was informed that people were continually getting hurt and did not stop this practice. And the answer to that question is far beyond my knowledge. If no- then I think the guy is out of luck, his decision to dive in he created his own injury, if it is yes- well then you do have to wonder why they continue to allow this to go on? I don't know the answer to the question.
