Gratuitous Transfer of direct points to brother - does it retain benefits?

With the current offer I am thinking about buying a large amount of points direct (1000+ to get $38pp discount). During this transaction we are considering buying some extra points for my wife‘s brother, and then make a gratuitous transfer to him. No monetary compensation to us of course :). I’ve read the gratuitous transfer thread and got a good idea on the process, but I still have some lingering questions, I am sorry if I missed them when I read the thread. I just don’t trust the DVC rep’s answers.

1). Can we make a gratuitous transfer so my brother in law‘s name is on the contract by himself, without us?
2). Does he retain the benefits of direct purchase and get a blue card?
3). Can we make gratuitous transfer of multiple contracts?

I know benefits retain when it’s done with immediate family.

Not sure if a brother in law counts. It seems like it would not matter but not sure.

You can always transfer the contacts but each would be it’s own. The question is more the benefits.

When we did it for our adult children, we remained owners.

Make sure the points you want to transfer are in a separate contract since you can't sell anything less than a full contract.

You need to talk to Membership Administration and not MS. That department deals with contracts.

As PP have said above, you can’t split a contract and give part of the points to your BIL. Also, for him to get a blue card, he’ll have to own at least 125 points bought direct from Disney. So when buying your points, you need to buy at least one contract that’s for 125 points, and that’s the contract you can transfer to him as a gratuitous transfer that will retain the blue card status. Or you can buy multiple smaller contracts and transfer several to him, as long as they total to 125 points.
 
Since you want to purchase 1000 points I would break that up into 100 point contracts or three two hundred and four 100. Keep in mind you pay closing on each contract.

For blue card, one needs to be at least 125, unless transferring more to the BIL that.
 
Thanks for all the advice! I am indeed splitting into 10x 100 contracts and will transfer 2 to him. Each contract will incur an extra $250 doc fee and $150 estoppel on sale, so $3.25 more per contract (I am splitting the estoppel on sale over 10 contracts instead of 5 contracts since the most I would have for a contract is 200 points). Talked to a resale broker, the small contract premium is more than $3.25pp and it takes much shorter time to sell in case I want to. I‘ll just have to docusign 10 times instead of 5 times.

Out of curiosity - couldn't you just buy 800 in your name, and another 200 in his name and you pay for it? He would sign his contract and you sign yours. The extra step of transferring the contract wouldn't be necessary.

In the end my BIL backed out but I still bought my points. Actually more than 1000, I am buying more direct with the plan to sell some SSR resales bought in 2020. I see it as upgrading the contracts.

But talking to the guide, I think what you proposed would have been doable. He just needs to get management approval to get a new membership number. In our case it will be clearly a gratuitous transfer situation since my wife and BIL have the same last name.
