Gifting from a friend

We are relatively new to all things DVC. We have a close friend who is wanting to get rid of their contract and is willing to gift it to us. Can we submit the contract to go through ROFR without a broker?

Our friend just got off the phone with DVC and they explained to her that since she is gifting it would just be a title transfer and not have to go through ROFR... does this sound accurate?

If you are buying it, it won't be considered a gift. Are you paying for the contract? DVC has resale value.

Yes, if it’s a gift no need for ROFR. Now I’m curious - what resort is it? Most DVC contracts, unlike other timeshares, can be sold for decent money, so, depending on which resort, that’s quite a generous gift.
 
I believe anyone (adult) can be the recipient of a gratuitous transfer and a gratuitous transfer retains all the original terms.

After searching quite extensively I could not find anything that directly refutes?

I have not seen posts that are clear on this because most of the reports over the years have been family.

Nothing requires them to transfer the benefits but we know they have confirmed they do for family.

Hopefully the OPs will keep the thread updated!

True. Looking from the other end though, isn’t it within the rofr process that gives them the ability to change the original terms?

I think the restrictions and how those were implemented give them the ability to not transfer during the change of ownership.

Yes, it’s not technically resale, but it’s a new ownership so it think that gives them the right to deny benefits and where points can be used.

Again, the number of transfers like this between people who are not related is probably very small which is why we may not have reports of what happens.
 
Don’t think we hear much about the ‘DVC Buddy Pass”. Friends are awesome but usually aren’t this awesome!
 
yeah, I'd love to hear how this goes. I've only seen benefits transferring within family. And would love to see how this works out.
 
There is a thread on disboards for DIY, to retitle the deed, step by step instructions. For wdw deed for example, most likely DIY costs is $19.20 + notary fee if your friend doesnt have free from their bank + stamps. Once they get the title redone and recorded, they would email DVC to get the contract membership updated from them to you. So basically if you want to think resale process in a grat trf re-title deed. For those wonder, "family" requirement is a myth, it is not required. Many members, I've seen on FB will however state this as fact, when they really do not know. Any member can grat trf / retitle their deed to someone else, the only requirement DVC has is no money exchanges hands.

No Sales Contract needed.
No ROFR needed. No CAF $500. No estoppel $150.
Member DIY the deed vs the title company, it's really not hard, just type it up, so simple.
Member writes a check to Orange County for the recording fee vs the title company.
Member emails the newly recorded deed to DVC vs the title company.
so Member can spend 30mins on this or as always companies will do it for you for a fee, some even provide online notary :)

Once DVC updates into your new member name(s), you may want to think about do I have my wife on there, maybe in a trust with trustees, anyhow 98.8% DVC mails you the golden bottle package as well :)
