Gamestop--IS this false advertising?

So in this page of Gamestop's sales flyer, it says you will get the Rock Band AC/DC track pack free with ANY Rock Band purchase. Well, my DS wanted the original Rock Band for Xbox 360, so I asked about the deal. I was told you have to buy a NEW Rock Band product. What do you think? Doesn't say anything about new in the ad.(Middle top of the page)

It doesn't state on there any exclusions. I would stay on them to get it.
 
On the last page in small print it says "See associate for complete details." So they could probably claim that covered it. But it wouldn't hurt to go back and ask the store manager about it. He/she might give it to you anyway since it wasn't clear.
 
I would go back and fight it until you get it. LOL It does say "any" AND the word "any" IS in bold print. It doesn't say it has to be a new one. So in my mind, I would say you could buy ANY one.
 

Well, I know one of the managers and we are in there all the time. I don't want to cause a stink since they have gone out of their way to help me in the past. I may go to another GS and see though. It's not something my son HAS to have, but he said he would use it if I got it.

I would go back or go to another store and say something. One the first page it says "Free 2nd WiiMotion Plus When you buy Wii Sports Resort." They guy working tried to tell someone that they didn't get a second one, the ad meant that they get a free one with the game. When the person finally showed him the ad he admitted that he had not even looked over the ad to see what the sales were. When it was my sisters turn he asked her "Do you want the second WiiMotion Plus?" She said of course I do....it's free!
 
Are you talking about buying a used game or just an older one? If it is used that could fall under the not valid with other discounts portion because a used game is discounted from the new. If you just mean a new version of an older game I think it is false advertising form the consumer point of view but maybe not the legal point of view.

I would assume that the offer was for only new, sealed games and not used ones though.

I worked at Gamestop (3 christmas seasons), and they do hire in idiots for the holidays, and some stores just have idiots in management that try to pull that stupid stuff all the time. There were stores we avoided sending customers to because we knew the people there wouldn't be of any help.
Just find a store with compitant people in it.
Or chalk up the extra few dollars for the new version to get the free ac/dc disc.

If the OP chooses to do this, she (or her husband) will need to have the game and the receipt - and the ad, to be safe - with them when they go to the store.
 
i'd just take the reciept and ad.

Now if the promo was through rockband, then it would have to be a new copy. Sometimes certain companies will do promos with retailers for marketing.
 
Well, I don't even mind buying a new copy, since it is only $2 more according to the website. I don't think they had a new copy though.
