That's not exactly true. The penalties are vastly different. However, to address your other point: two 14 yo having sex, while very disturbing does not create criminal liability because they are both incapable of consenting. Moreover, there is no inherent inequality in that relationship. An 18 yo senior and a 14 yo freshman are inherently unequal. I would not say that about an 18 yo senior and a 17 year old junior, but 14 and 18 are different worlds.

In Spain it's 13. In several countries the age of consent is 14.

And, in some States of Mexico it is 12. JMHO, but that is perverse.

I still haven't gotten past the fact that having sex in school bathroom stalls is not the outrageous portion of the story.

No one is "okay,"with it. But some do have sex at that age and it seems odd that there are no criminal repercussions when a 14 year old has sex with another 14 year old or a fifteen or sixteen year old, but If Senior who 's had their 18th birthday has sex with a Freshman than charge them with felonies and brand them like you would an adult molesting a 4 year old.

Most people are seeing this issue as more of a grey area than black and white one, but that doesn't mean they are okay with 14 year olds having sex.

There are criminal repercussions. This isn't a "new" law. 18 is considered adulthood. 14 is still considered childhood. There are males that are branded sex offenders that have done the same thing as Kate. Why should she be treated any differently? Should she get special consideration because of her orientation? I don't think so.

Yes she can. The victim must be between the ages of 14 & 17. The accused can only be four years older.

No, the wording is confusing. I read it that way at first, but it is the victim who must be between 14 and 17 years of age.

ETA: Think of it like this- Is not more than 4 years older than the victim of this violation (who was 14 years of age or older but not more than 17 years of age) at the time the person committed this violation.

Seems like it says the person being considered for removal from the sex offender registry shall be considered if they were not more than 4 years older and not older than 17.

Of course it isn't a given. Nothing is a given when you go on trial. Just ask anyone who followed the Casey Anthony case! But that is the chance she took when she broke the law.

Not the same...hence different jail times; both are sex offenders though. Besides, as everyone else pointed out, she can petition to be removed. She's just barely within the limit.

I don't think she is eligible for removal. I think it reads to be considered she could not be more than 17.
